Have I got a case, or do I leave it?

I've bought a dress bnwt via eBay, from a personal seller, for just over £30 delivered. The dress has arrived in good time, well packaged, with tags BUT....
The top part of the dress is ruched with buttons, the buttons are very misaligned so do not sit straight down the chest. This causes one side to be a lot more ruched than the other. The whole thing doesn't look right?
Now the dress is indeed bnwt, but the fault is quite obvious & wasn't listed. I have emailed seller, but they are stating no returns & it is brand new. Do I have any comeback for this?
Any help would be great, thank you.

I think you have a case.
You've bought something expecting it to look one way, but it looks different & has a fault.
They can't refuse a return if it's not as described.0 -
Yes you have a case, it's unwearable and not as described. Your seller can keep repeating the 'no returns' mantra as much as they like but they can't enforce it.
Go to paypal, file an item not as described dispute. You will need to send the dress back via trackable means which you probably wont get back but you will get your initial postage and full dress costs returned.0 -
Thanks for your opinions
I've emailed my seller & shall wait to see what she says."Beauty is in the eye of the beholder and it may be necessary from time to time to give a stupid or misinformed beholder a black eye."...Miss piggy0 -
Just to add that if you return via My Hermes it should only cost £3 to send this fully tracked so will reduce your loss.0

Can you reposition the buttons and fix the problem?
That might be less hassle than returning and you get the dress you like.0 -

have you seen it?
how do you/we know it's not supposed to be like that? There's plenty of women's clothes that are designed asymmetrical or sometimes just plain weird, you see them all the time. The questions that get the best answers are the questions that give most detail....0 -

Obviously not, but as OP says "The top part of the dress is ruched with buttons, the buttons are very misaligned so do not sit straight down the chest. This causes one side to be a lot more ruched than the other. The whole thing doesn't look right?" and she has seen it I'd guess she'd know what she's talking about eh?

I think the chances of a dress being misaligned and uneven by design are extremely remote don't you?
Now, is there anything else you'd like to pick at for the sake of it?0 -
A 'private' seller with a BNWT item is best avoided, perhaps they are selling it because when they tried it on they realised it was faulty as well.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. Sorry for not updating sooner- the seller has now agreed to a refund & myhermes has been booked to collect tomorrow.
To answer a few questions- No, it is definitely not supposed to look like this. It looks downright silly, giving the effect of 1 massive boob & 1 flat side, not my best look
Avoriaz- I did think of maybe getting it altered, but with the material it wouldn't be possible.
And yes, the photograph was pants. Quite dark, not really showing the top. I took a chance because it was bnwt, a brand I had bought before & a seller with 300+ feedback at 100%
I really appreciate everyone taking the time to read & respond, thanks."Beauty is in the eye of the beholder and it may be necessary from time to time to give a stupid or misinformed beholder a black eye."...Miss piggy0
