HI ,
I am going to court on 21.05.14 for bankruptcy , i have almost got everything ready, just trying to sort out my SOA, just wondering if anyone knew after the backruptcy hearing and the meeting with the OR is done, how often throughout the 1st year of bankruptcy do you have to meet with the OR.
any info would be great , thanks.

Hi...in a straightforward personal Bankruptcy...if not self-employed, or part of a business, the BR will not physically 'see' the OR at all.
Usually....there is a telephone conversation soon after the time of Petition [might be done straight away, at Court?] with the OR's office, to determine immediately what accounts] one is using, for day-to-day spending. This is pretty much a cursory information gathering exercise.
Subsequently, at a pre-arranged date to suit, there will be either a face-to-face meeting, or another telephone interview, with the OR, to go through the paperwork, and deal with the BR itself. This might involve the checking of statements, or confirming account numbers.....identifying assets, etc....and seeing if a surplus of income is immediately identified. [information about the interview should be available in the stickies?}
Invariably after that, communication is by post or email.
Unless the OR identifies a problem, in which case, another interview to clarify matters, could take place? No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
I believe you have to contact the OR if there is any change in your circumstances as well0

thank you for your replies. i am just nervous about the whole bankruptcy.0

Nervous is normal
Usually there is one telephone interview in couple of weeks after your petition. There may be a follow-up one if you need to find more paperwork. (That is obviously assuming that you are a "simple consumer" bankruptcy, you don't have a business or complicated assets.)
Have you got all the forms sorted?0 -
Honestly, don't worry about it. it's normal to be nervous as this is a life changing step you're taking.
However as long as you have taken good advice and you are sure this is right for you, then making the jump into BR can be a liberating and positive experience by giving you the opportunity to move on from debts that you know you cannot pay.
Personally, I had a phone call from OR about 2 weeks after court then have only had a couple of letters advising of an NT tax IPA.
Good luck for next week0 -

Brilliant, that's one of the ones we would recommend.

Don't worry about it, the OR can get anything that you don't have.

Do you have to take a years bank statements to court with you? What other paperwork are you taking (apart from 6.27 and 6.28)?0 -

No, the only paper work you take to court is your copies of the 6.27 & 6.28 forms.0
