Ticket Bought wrong registration

Hi all,

I'm new to this, I've had a look through this forum for a case similar to mine but can't seem to find one. I can find plenty about the PPC though. I hope you can help me along the way through the appeal process. There appears to be a lot of knowledge and helpfulness on here.

Here goes;

My offspring being the keeper of the vehicle in the PCN received a PCN yesterday from Civil Enforcement Ltd saying 'no/insufficient tariff paid' and requesting the what appears to be usual £60 or £100 if paid after 14 days. The PCN was issued within 7 days of the parking date. The driver had paid for a valid ticket but had put the incorrect registration in. We have the ticket and the times on the ticket cover the period of the parking noted on the PCN.

I've told said offspring not to pay in any circumstance but obviously need to appeal.

I'm thinking about using the template on the 'newbie thread' but it didn't really seem to fully apply. I know what I'd like to tell them, but it wouldn't get me anywhere.........:A.

I thought about adding the following to the template;
The Vehicle noted in thePCN clearly displayed a valid fee paid parking ticket (copy attached) coveringthe period you state no/insufficient tariff was paid. Together with a note about ANPR signage lacking.

But do I need all the other stuff? This seems to be a fairly clear cut case in my jaundiced eyes?

Because the NTK was the first notification we had it appears the Car Park is ANPR monitored, I've checked the signage there and whilst there's lots of signs in the place none of them say the car park is ANPR monitored. Is that relevant?

Do I need to reply with a long letter as in the template or would a more succinct response be better?

Oh and Offspring visited the shop today that the car park is related to (I'm not sure they own the land) and the manager said if we get no where with an appeal to go back to him. So that might be a last resort.

Should I send a letter to his CEO anyway?

I'd appreciate any help with this as it needs to go away. Offspring only passed test in Feb this year and is a bit upset, therefore I'm a bit upset too!! :mad::mad:

Thanks
Ned

    Appeal to Civil Enforcement using the template. You can add a point about the ticket, but the reason you will win at second stage will be on no GPEOL.
    Likelihood appeal will get rejected. You then appeal to POPLA again using forum help and template and you will win.
    The reason for the PCN is not the issue, it is the reasons that you will win that are important. So simply follow advice on Newbie thread and trust the tried and tested formula.
    It worked for me today and it will work for you.
    Newbie thread: go to the top of this page and find these words: Main site > MoneySavingExpert.com Forums > Household & Travel > Motoring > Parking Tickets, Fines & Parking. Click on words Parking Tickets, Fines & Parking. Newbie thread is the first post. Blue New Thread button is just above it to left.

    If the Reg No was only slightly incorrect, then a straight appeal based on the real circumstances may get a cancellation. Particularly if you can provide a copy of the ticket.

    However, if it was completely the wrong Reg - i.e. for another vehicle, then a standard soft appeal, as suggested above, is the right route.

    Parking Eye do have a reasonable record of accepting that people make digit problems, but this lot may not be so accommodating. Let us know the outcome.

    Thanks for the advice guys.

    The reg number on the ticket only had the two digits and none of the letters as a lot of the car parks round here only have the option to insert the digits, so I'm thinking the right route is the 'soft' template from the newbie thread?

    Thanks again for your help.

    Yep use the template appeal (all the 'other stuff' is important especially with CEL who sometimes don't operate a breach of contract model!) but add a point 4 as you planned:
    I thought about adding the following to the template;
    The Vehicle noted in thePCN clearly displayed a valid fee paid parking ticket (copy attached) coveringthe period you state no/insufficient tariff was paid. Together with a note about ANPR signage lacking.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    So, you paid the fee regardless, hence the loss to the landowner is zero. Unless they are claiming that it's a penalty (which they won't), they would never win on trespass or breach of contract claims. Follow the excellent advice given above.
    Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.
