Claim too old ?

Hi,

I have read that legislation did not exist pre 2005, but I thought it best to ask someone who knows in this area before closing this off (with much resentment to the sellers).

I 'bought' a policy via Carrington car (D&D Homecare but their name changed) and this was sold to me as a "you must have this or the mortgage company will not accept you"... so mis sold in my view.

The policy was sold to me in October 2002 and would run until December 2004.

The Mortgage was with Halifax plc but it is the 1700+ PPI I paid that was added to my mortgage that I am trying to claim back. Not to mention the terrible advice at the time and the other thousands they cost me. Impartial advice I was told :(

Can I still claim for this ? I do have all of the details of the policy.

    Its not a claim. its a complaint. In most cases, mortgage brokers only became regulated in January 2005. However, a small number subscribed to the mortgage code which means they do have to consider pre 2005 cases.

    However, CC closed down and went into administration. L&G only took responsibility for L&G sales and the actual mortgage advice (that became regulated after Oct 2004). It did not take on liability for general insurance sales placed with other insurers.

    So, if it wasnt an L&G policy (and it almost certainly wasnt as L&G didnt do single premium MPPI IIRC) then whilst you have a valid complaint reason, you have no-one to complain to as the firm that sold it no longer exists. The FSCS would normally step in there but they only consider sales made from 2005 onwards.

    How disappointing... not least for the cash element but also as it sickens me that there is a line drawn in the sand and these people escape it. They clearly knew what they were doing and the methods they employed to do it. Being new-ish to Mortgages at the time and being assured it was impartial advice, I fell for the pitch.
