Defence

Hi everyone, i have an hearing in June (parking eye) i have done my amended defence and it is almost ready to send off. In my defence i have referred to several court cases that have been won against PE. Do i need to print off the full court transcripts and send them off, or is it enough just to refer to them showing why the cases have been won by the defendants? many thanks for any advice offered.

    You don't have to submit them, but you may want to take them with you on the day.

    Thanks da_rule, that's saved me printing out 3 copies of all transcripts. Ps, i would have been going into court with a wheel barrow ha ha.

    I am sure I've mentioned this to you and it is in the NEWBIES thread, but make sure you write to the local court Judge now to ask respectfully if there is a possibility of the hearing to be vacated and the claim 'stayed' for the outcome of the Cambridge ParkingEye 'test case' decision by HHJ Moloney which is due soon. And/or an Order for POPLA instead, as shown in this thread on pepipoo:

    Try to avoid the hearing altogether, assume your Judge knows nowt about POPLA or the test case! Write now even if your initial defence asked for a stay. Writing separately to the Judge can work, now. Copy in ParkingEye to show them what you are writing to the Judge, use enforcement@parkingeye.co.uk

    Hi Coupon mad, i am grateful for any help/advice that i receive on these forums. I have sent an email to the Judge at my local court asking for my case to be decided by POPLA and i referred to cases that have been sent to POPLA from the courts. I sent this email on 29/04/2014 and have not yet received a reply. I did post this on Pepipoo as i am also a member of that forum. As for the Cambridge case, i have been advised, again on the forums not to mention that case in case it is not won and could go against me. As you can see i am looking for good advise as my hearing is set for mid June and therefore i only want to do what is correct. cheers, RR

    I would pop a snail mail letter to the Court in the post as soon as the Cambridge decision is made, if it goes the right way. Then you can mention it plus remind the Court about your email requesting a direction for the claim to be referred to POPLA instead, as it's the bespoke ADR for this industry. Keep an eye on this forum and pepipoo about the decision when it gets handed down by HHJ Moloney.
