belmont parking services

Hi
hoping someone can help, I have had a look and can't seem to find the answer to this!
Yesterday I parked in a car park operated by Belmont Parking services, I bought a ticket for the whole day which cost £5.
On return to my car I had a PCN. Saying that my ticket was not visible. I checked and realised that the ticket must have blown upside down when I shut the car door so they are correct in saying it wasnt visible.

what do I do?
Thanks.

    Hi doolah1302,

What you need to do is covered in the advice in the NEWBIES sticky thread on the main page of the forum.

Also take a look at this thread posted by someone else also dealing with Belmont

    Thanks, however my query is,
By buying a ticket I have acknowledged that I needed to do so and therefore the information given which tells you to deny knowledge of the need to pay, poor signage etc doesnt apply to me.
    Do I
Appeal-sending evidence of my proof of purchase
    Pay
Do nothing and continue to ignore.
    Thanks.

    Hi all

I am very confused I got a parking ticket on 3rd of March sent an appeal straight away As signs for parking were not visible the sign was on the other side of the building!!

Anyway I got no response to my appeal until yesterday when I opened a letter frm debt collecters plus to say I now owe 160 as I ignored the first two letters from Ukpc .

How do I prove I haven't received any letters ??

    What do I do next??

You need to stop jumping onto other peoples threads.

It's rude and can be confusing to people trying to understand what post is for what person.

Sorry but you are missing the point.
The driver bought the ticket and got a charge anyway for allegedly breaking a parking company defined rule set up to help snare people into paying a ludicrous sum for some minor infraction they make up.

The advice in the NEWBIES thread for your situation is to Wait for the Notice to Keeper to arrive and then send the 1st appeal template letter off as the registered keeper. The legal arguments in that letter apply in almost all circumstances.

The circumstances don't matter. What matters is that the punishment doesn't fit the "crime". The sum they are charging is supposedly damages for breach of the parking contract - damages must equal loss. How could they possibly have lost that sum of money just because a ticket was the wrong way round?

So you challenge as the registered keeper once the NtK arrives using the template appeal letter which covers; not a genuine pre estimate of loss, no authority to levy charges and pursue them through the courts in their own name and non-compliant signage therefore no contract with the driver.
It's up to them to prove their signage was compliant and fully informed the driver of all terms and conditions - not just the tariffs. You don't need to do their job for them.

The aim of the 1st appeal is to get a POPLA code so that you can submit a second stage appeal to POPLA which you will win.

Would suggest you read the NEWBIES thread through a few times to see why the advice is as it is.
