Probates- do the probate department need the WILL to be sent, to the department?

when completing the probate/letter of admin process for your deceased spouse,

and a will was created, then do the people you send the forms (PA1) to , do they need to see a copy of the Will or the original even?

or do they just need the details on what is written on the will?
-If so, where do you write these details on? which form/or part of the form?


(There is no inheritance tax to pay,)

    The original Will goes in. Assuming you are doing this yourself you will be arranging an interview time at the Probate Registry.

    When the other forms are ready give them a call and ask exactly when they want the original Will from you.

    You send the original will which they keep as it is a matter of public record. Worth making sure you have a certified true copy before you do this in case anyone else needs to see it.


    I was my father's executor last year. I didn't have to attend an interview.
  • When completing the forms, there's a checklist telling you what to send.

    If you are concerned, then send it via Special Delivery post so that you have some coverage should it go astray, having kept complete copies of everything yourself (and/or get a certified copy of the will as well.)

    The Sealed Probate is sent back to you ordinary post - that felt a little insecure given how important the document is to you!

    However, the system seems to work quite well - you don't seem to hear of much of this going astray (cue lots of posts with horror stories! :eek: )

    When you fill out form PA1 you can tick a box to request swearing the oath locally rather than attending the probate registry. They will then send out a form for you to take to a convenient solicitor to deal with.

    Get a certified copy(ies) of the will from a local solicitor before sending it off with the form PA1 for peace of mind in case it should go astray. Take the will in intact and let them copy it. Don't separate the pages of the will or remove any attachments to it.
