Excel threatens me with debt recovery

Hi All

I parked in one of the Excel car parks paid my ticket stuck it on the window. When I came back after work 8 hrs later I saw this yellow notice letter stuck in my window claiming I didn't display a valid ticket. It was a rainy day and steam in my car caused the ticket to fall off upside down. I sent an email straight away to excel disputing the charge and even included my ticket with. This was in November 2013. I didn't here anything until April 2014 and they were still demanding me to pay £100. I sent them a second letter requesting a POPLA code which I never got. They have now sent another letter saying they are passing my case to a debt collector.

Are they allowed to refuse to offer me a POPLA code. They said they were not able to respond to my appeals because I didnt provide a valid address. They are also saying they wont correspond with me anymore but I should contact the debt recovery company.

    Any debt co follows instructions of 'creditor'.


    best wait for any d/c letter, write to them- cc Excel - disputing charge.
    Long time away from MSE, been dealing real life stuff..
    Sometimes seen lurking on the compers forum :-)

    I would also send a complaint email to the BPA. As per the NEWBIES thread, email address is there too. You appealed by email so there was no reason you could not be sent a POPLA code and rejection by email - anyway they would have got your postal addy from the DVLA and seen it was you appealing.

    If it helps I would never regard any statement of a PPC that they were going to send the case to a debt collector as a threat. I would treat it in much the same way as I might if they were to tell me that they were going to their local ice cream manufacturer.

    Debt collectors have no more power than you or I to pursue debts. So, that boils down to the fact that they can ask you to pay up and, apart from impetuously stamping their feet and doing a little bit of childish shrieking, there is sweet Fanny Adams they can do beyond that. It is rather like being mauled by an old dead sheep. Toothless, bloated and stinking.

    Besides, so far, no debt collector has ever issued proceedings for an unpaid PCN. There were approximately 2 million of them issued last year alone so what makes you think you will be the first?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    After waiting today I finally received a letter from Gladstone solicitors threatening to take me to court unless if I call Roxburgh and settle the payment.

    Since they didn't include an email address is it best to write a letter to them disputing the charge?

    Right, I have had a read, I am gonna send a letter to Gladstones to stop contacting me and send another to Excel and tell they are in breach of rules for refusing me a POPLA code as they are saying they didn't have a valid address to respond, funny though they managed to send a letter to my address requesting payment. I will also write a complaint to BPA telling them Excel are refusing to offer me a POPLA code.

    Is this the right course to take?

    I didn't write it then, I thought I was supposed to wait for the solicitors letter then reply to them and Excel and then write to BPA.
