What income does your partner have from his agency work? Is he continuing to claim JSA?0

last week he got £37.98 he worked one day
this week he is working two days
he was told he cant claim jsa at the same time which i thought he could
in the last 4 weeks he has worked overall 4 days which isnt a lot of money time tax and ni is taken out0 -

He shouldn't be paying any tax or NI on such small wages.Trying to be a man is a waste of a woman0 -
i though that as well i will have to ask why he is paying that0

You need to apply for Employment Support Allowance.
See here: http://www.nhs.uk/CarersDirect/moneyandlegal/otherbenefits/Pages/ESA-claims.aspx
As you are 38 weeks pregnant you will automatically be placed in the support group as working would be detrimental to your and the baby's health.
I am assuming that you will not be entitled to contribution based ESA so you will be assessed for income based. This means that your OH's income and your savings will be taken into account.
Do this today.

And ask for it to be backdated.0 -
