Claiming back car insurance excess for a none fault clain

A woman crashed into me last week, my insurance company have offered me £2500 for my car. My excess is £425 so they said that they will write be a cheque for £2075 now then send me another for £425 when they have claimed the excess of the woman insurance who has already admitted liablity.

This is no good for me as in need the £2500 to buy another car. Is there anyway around this? If nt how long does it take to claim it back?

My insurance is with Admiral, I have no legal cover but I have been in touch with a solicitor due to injuries sustained by me and my girlfriend.

Thanks

Claim direct from the third party's insurers.

  • How do I go about that and how long does it take?

    Depends if they dispute liability.

My mum had a totally non fault claim drag out for 2 years. They took forever replying to everything.

But it maybe the same timeframe as claiming your £425 back.

Do you have a hire/courtesy car?

Usually the cost of a hire car can exceed the claim so may help speed them up.

I have had two non-fault claims via third party insurers.

One was direct via the third party, they admitted liability straight away and provided a credit hire vehicle while mine was repaired.

The other was disputed for over three years pending court action (which I/my insurers won). The car in this case was written off. My insurers paid out, less my excess, within a week of the accident, then three years later I got the excess cheque. What was worse was that I lost my NCD in the interim. This was reinstated, but involved contacting all my insurers for those missing three years to adjust all the policies and get refunds.

It isn't the norm for your insurer to reclaim any uninsured losses for you. So Admiral are doing you a favour.

Whether you can get it any quicker by going direct yourself is an unknown quantity. Phone and ask them how long they take to raise a payment like this when liability is accepted.

If it sounds quick, send them the evidence of your deduction for excess and inform Admiral you are dealing with it yourself. This will cut out the inevitable delay you will experience awaiting Admiral to pass it on to you.

Maybe another (quicker) way to get hold of £425 could be to get your PI solicitor to get you an interim payment on your injury compensation claim.

Two or three years ago, I was hit twice while stationary at different times.

Both times I claimed directly from the other partys insurance company and both took less that 10 days to sort it out from start to finish.

If you believe the other party is at fault, get their insurance details from askmid.com (if you don't have them already) then find a phone number for them and ask to speak to the their party claims department.

In fact, ideally you should be claiming the whole sum not just your excess, and not even making a claim on your own policy, but since your insurers are already involved its a bit more complicated. Your insurer may cancel the rest of the policy (without refund) once you accept their offer. If that's the case, you'll need to ask the third party insurers to pay for the period of insurance you have lost, as well.

Contact them straight away. The cheapest solution for them is to deal with you very promptly so that you don't make a claim on your own policy or have to get hire cars and so on.
