sold as seen

ON bank holiday Monday we decided to buy a caravan.As it is a second hand van we were told it was 'sold as seen'.The sales person was taking us through the things included.He mentioned the items included in the van.Everything you see he said.I asked and he said as it had been the subject of a non-payment of finance this included all that was in it.TV,DVD player,crockery,bedding,decorations etc.Saying they'd got them for nothing so they wanted nothing for them all.On Tues I recieved a call saying no probs with the finance but that the former owner wanted her things back and had asked for them to be boxed up for her.Should we push for things to be replaced or have we a case at all??:(

    Do you have a contract / bill of sale stating these things are included ?

    You could ask for the items to be replaced, but I wouldn't bet on them agreeing. You would be better asking for a suitable discount (bearing in mind that type of stuff is worth virtually nothing second hand) on the purchase price, or you can try and withdraw from the deal ( but that may depend on the answer to what the contract actually says).

    Tell them it is sold as seen as they stated. Either they replace said items or reduce the cost by an amount agreeable to both of you.

    Any issues with the former owner is not your concern.

    Selling due to non payment of finance would say to me its been reposessed by the finance company.
    Why is the dealer in contact with the previous owner?

    I do hope you get a proper inspection and its not riddled with leaks and damp.

    They maybe selling it on behalf of the private seller which will give you no rights if it turns out to be a lemon.

    Get it inspected.

    If it's a decent TV/DVD player that will run well on 12v it definitely is worth having.

    I've just sold a second hand one for £220. They aren't as easy to come by as you'd think.

    OP what about things like waste and water pipes, leisure battery, gas bottle, awning, water butts etc? I would check the basics are all included still. They weren't when we bought ours and buying these will cost a pretty penny.

    I suspect the contents are still owned by the debtor, it's the "vehicle" that can be sold.

    As such they have every right to their belongings back. Are the items part of the original finance contract?

    If not they still belong to the debtor.

    Since it was sold as seen I'd argue that the price was based on the entire thing, since they had no legal right to sell the contents, the price is now renegotiable.

    Hence my comment.

    I believe the contents are the debtors, the vehicle can be repossessed.

    Really? This is based on car experience but I thought that's exactly what "part exchange to clear" was?
