Occupied House Insurance during probate

My dad's House is going into probate. My brother and I are both executors and beneficiaries. Dad's bank who he has insurance with have said that the insurance should go into my brothers name as he is still occupying the house. Our relationship is a bit strained and I am concerned that if he damaged the house in any way I would lose out as the insurance would not pay out.


Can anyone advise as to how to protect my own insurable interest in the property? Would the insurance be covered in respect of my own insurable interest if
the insurance was in joint names?

    I assume you are talking about buildings & contents rather than just contents.

    I would say that it should be in the name of 'The Estate of....' or 'The Executors of ....'

    To put it in his name just because he lives there doesn't sound right.

    He has an interest in his own belongings but you both have an interest in your Dad's building and contents.
  • Yeah, I thought it would be something like that, it would have to insured in both names as I have an insurable interest possibly both as an executor in safeguarding the estate and as a beneficiary.
