Smart Parking/Asda

Hi guys,

I've recieved a PCN for the 23rd of April, for parking in an Asda car park all day.!

They put a poster up saying ANPR will be in operation as of the 28th. Shall I follow the first sticky and add this into my complaint/refusal to pay?!

I have a photo of the sign saying it starts on the 28th.!

Cheers

Just appeal as per the NEWBIES thread, but include the extra item ...

    x) The PCN was issued without authorisation or validity. The date of the "offence" is stated as 23/4 yet the commencement of the new parking scheme was not scheduled to start until 28/4 (see attached photograph of signage at the site).

just use the appeal letter and add any extra evidence you feel is relevant, but do not admit to being the driver and do not imply it either

also complain to asda and get it cancelled
  • Ok thanks.

Even though I had parked in there for the whole day when it states that its 3 hours free parking. Although the poster contradicts as it says the ANPR will be in effect as of the 28th, do you still think i have grounds to complain? I've literally been parking there since Christmas but have stopped as of the 28th
  • I've just gone on their website to appeal it and is already been cancelled. Happy days!!!

Wow that was quick - I expect they've had complaints from others & routinely cancelled all those before the commencement date. BTW if you ever get another one - you always have grounds to appeal ANY private parking ticket - none are fair. It is a fact that PPCs charges are either not a genuine pre-estimate of any loss, or they are a disguised penalty dressed up as a 'contractual sum'.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
