Hi everyone, I'm new to this site but I've been trying to reclaim my bank charges over the past few months. Without going into detail there were mitigating circumstances to my bank charges which (for me) was a lot of money. Anyhow, I've received a letter from my banks solicitors which states:
'We have been instructed to write to you as our Client is, entirely on a without prejudice basis and with no admission whatsoever to liability, minded to enter into settlement negotiations with you but before doing so, we are told that there appears to be a discrepancy in what you are seeking by way of a refund of Bank charges.'
Am I correct in thinking this sounds like they are on the verge of making me an offer - or are they trying to get out of paying me anything? This particular bank (which I won't name until I find out how things turn out) have been phoning me at work (even when told by people in authority personal phone calls are NOT allowed at work), phoning my landline and phoning my mobile - I see this as harassment and have written to the bank on numerous occasions to complain about their treatment. I have a certain time alloted before I need to reply to the letter from the banks solicitors so any advice from people who can help would be much appreciated. Sorry this is so long-winded - just be grateful I haven't given you the full story!!

Unfortunately, your failure to disclose the story, make it difficult to help.

If you have only claimed the bank charges, they would put the offer in writing. But you mention mitigating circumstances?
However, it sounds like an offer is imminent, but maybe you have claimed the wrong amount?0 -
Sorry techspec -I should have explained that it appears I may have gone over the amount by approximately £70 - but I'm claiming £2323 over the 6 year period. Some of the claim is through a 3 month period of ill health last year when I wrote to the bank explaining my firm did not (at that time) pay sick pay (my firm have since reinstated sick pay - just my luck!) and I was going to find it difficult to manage. I asked the bank for some form of help - they didn't even have the decency to acknowledge/reply to my letters. I made appointments and went in to speak with financial advisors who were less than helpful. I have kept every copy letter and every proof of posting (recorded delivery). I hope this makes sense.
