Good morning,
just after a little advice if possible, i work for a leasing company and one of our vehicles was snapped going in and out of macdonalds gatwick, exceeding their stay by 30 mins, after scouring the forums it would appear we are under no obligation to pay it, just curious how to word a letter to them in order to stop them continuing to pursue payment.
any help would be much appreciated

Dear MET,
We are the registered keeper of the vehicle, but not the keeper of the vehicle according to POFA 2012 definintion.
The keeper of the vehicle at the time of the incident was:

Good luck with getting your notice to keeper to them in the 14 day timescale

That last bit is irrelevant (as far as I know) ... the 14 days timescale applies only for the notice that the OP's company has received (notice to keeper). MET will then have to send a notice to hirer (which has nothing to do with POFA).0

great stuff, but i was hoping to leave the driver out of it as i would rather they dont pay this ridiculous penalty, am i under any obligation to provide the drivers name and address?0

All it means is that MET can continue to pursue the keeper. Of course you are perfectly entitled to appeal as keeper, as long as YOU are empowered to represent the registered keeper (if it is the company's name). The appeal template from the NEWBIES thread is what you would sent.
Are others in your company aware of your intentions and are happy with this course of action? Naming the driver removes any LEGAL LIABILITY from the company.0 -
Yes the notice is addressed and car is registered to the company, i am empowered to do what is necessary, it was a director of the company that insisted i try to follow this course of action, under the impression that we need not worry the driver about the issue and be able to successfully appeal. this isn't the first time we have received one of these notices and i'm sure it wont be the last but if i can nail it so our customers need not worry for now, (until they change the laws or rules to successfully implement these charges) then great stuff.

Are you a car hire company? If yes please feel free to identify the company - companies that put the customer first rather than try to fleece them over these speculative invoices should be encouraged.0 -

You can successfully appeal instead, if you prefer not to bother the driver! It is a 2 stage appeal procedure and you would win - we have the wording in the NEWBIES sticky thread near the top of the forum. When MET see our second stage appeal wording at POPLA stage, they cancel immediately. look, this is a typical outcome:

So you could create a standard first appeal template in the office, based on my template in the NEWBIES thread and a POPLA appeal based on the examples in post #3 of the same sticky thread. And if ever you lose at POPLA, then your final letter would be to give the name/address of the driver to discharge your potential liability. A win-win approach as long as it's swiftly implemented each time.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
