Carpetright may not give full refund

Last week we had someone from Carpet Right come round and take measurements for estimate for new carpet. Later in the week they called to tell us what the price would be, we accepted this and paid in full on Sunday, and booked in a date for it to be delivered/fitted.

Today we got a call to say that they made a mistake on the original quote and we have to pay £150 extra. This makes it over budget, but they won't budge. Fair enough, so I told them I wanted a refund. They couldn't do the refund there and then for some reason so someone is going to call me over the next few days to sort it out.

However the guy did say that we may not get all our money back because the carpet has already been ordered. TBH if this is the case we might as well just pay the £150 extra. But this is their mistake, surely I would be entitled to a full refund?

    Yes you are entitled to a full refund - it's them rescinding from the contract. If they've ordered it then that's their problem. And puts you in a good position to barter if you want it

    Also if it's a quote and not an estimate then that's their problem to deal with.

    Thanks for the replies. Apparently the full refund will go back on my card within 3 days. The guy kept going on about how they'd already ordered the carpet and had it cut - how is this my problem. They might as well just have absorbed the £150 instead.

    If a contract is to be considered balanced, it must be equally binding upon both parties.

    That is to say, the supplier is bound to supply the items at the agreed price and you are bound to pay the agreed price for them.

    If you would be unable to cancel the order (because of it being cut) then they are unable to cancel the order (and also unable to change the price that was agreed). Once a contract is formed, neither party can cancel without being responsible for reasonable losses incurred due to their breach.
