Hi Guy's,

I have been in dispute for a couple of months regarding https://www.book-your-theory.com.

We paid £49.50 to get my Son's theory test booked ( yes I know it isnt the official .gov site ) and have since been advised to contact my bank to ask for a chargeback.

This I did with all the necessary information etc. received a letter today from Santandar with the advice of: I am unable to pursue your claim as your dispute is with the merchant

I am due to contact my bank again, but I thought this is why we started the process in the first instance.

Any advice appreciated.

    The reason your bank cannot refund your money is because the seller has provided the service you paid for.

    In other words, there is no legal reason for the bank to be able to recover the money from the seller.

    The dispute is because the seller did not provide the service.

    The letter from the bank doesnt offer any indication that this is the reason, but I accept that this may be the reason the bank cannot pursue the claim, but it seems a little odd that they havent outlined this reasoning clearly in the letter.

    The website you mention does not exist, so it is difficult for me to confirm what service they were due to provide.

    I imagine they were going to collect your particulars and the book a theory test for you.

    I would also guess that their terms and conditions also made it clear that by you actually paying them, you were agreeing to them starting to provide 'the service' immediately. Starting to provide the service could mean processing your details in preparation for actually applying to the DSA for a booking.

    Unfortunately, the Distance Selling Regulations allow them to avoid refunding you in this circumstance, thus there is not a legal possibility for your bank to recover the money.

    Of course, all that is pure guesswork without seeing what you actually agreed to on their website.

    You need to ask your bank what "I am unable to pursue your claim as your dispute is with the merchant" actually means.
