Council Tax Housing Benefit

My stepdaughter who is currently 17 years old, has recently moved into a flat in Peterborough. And i was wondering if she is entitled to housing benefit and council tax benefit.

She takes home £770 per month for working on average 35 hours per week. Lives on her own. Her council tax is £62 per month (with single persons discount already applied) Her rent is £395 per month for a 1 bedroom flat.

Just had a second thought aswell, i thought people only had to pay council tax if over 18 years of age. My stepdaghter is 17 so anything she has already paid would this be refunded??

She is really struggling at the moment and any help would be much appreciated.

    Council Tax is not payable by anyone under 18 yrs of age - she needs to contact the council and ask for a class S exemption (under 18).

    As she's too young to pay Council Tax she wont get any Council Tax Benefit until she's 18 however once the Class S exemption is given she'll get back anything she's paid.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Thank you so much for taking the time to reply. Im somewhat boggled to the fact that when she went to the council tax office to say she moved in and filled out forms to start her council tax that they didnt say oh your 17 and not liable for council tax. havent even heard the mention of the expmption class s. I will get her to go and sort this out and hopefully she will get refunded what shes paid for the past 3 months. She will be 18 at the end of this month. Is there any other help she is entitled too??

    It's not a common one - I work in Council Tax and its very rare that I give this exemption , I suspect a lot of people out there are entitled to it and not claiming it.

    Give them a ring on Monday and get the appropriate form.

    Funnily enough - all my basic training was done by a guy who used to be a Ctax manager with corby borough council.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Thanks for the help. My stepdaughter lives in peterborough so im hoping when she goes to sort this out, the people in the ct office there are as helpful as you. Based on the figures i gave in my initial message on this, what sort of figure do you think she will get by way of ct benefit? and housing benefit? and is there anything else that jo public wouldnt know they are entitled too?? thanks again you have been fab today xx

    I have just typed up a letter for sam to claim her under 18 yrs exemption. Have done a calculation on the site too but unclear what she is entitled too. will just get her to claim and see what she gets if anything. Thanks for your help YET AGAIN lol xxxx

    I also paid it when under 18, only found out I shouldn't have last year!

    You could estimate the housing benefit/council tax benefit using this
    https://www.wolverhampton.gov.uk/webforms/(z5zc4k45ngv0kf45txy2vn55)/housingbenefits/hbcalc.aspx?src=999 I do have a feeling she will not be entitled to anything as I am sure my friend earns less than that and has to pay full rent and council tax. £770 after deductions comes out as no award payable on that calculation system.

    Edit sorry just seen the Peterbrough one was posted, think it's the same sorry.

    However it is always worth applying, the worst they can say is no. She will of course however get her single occupiers allowance.

    She will be 18 at the end of this month
    I think by the time she fills in the exemption form and sends it off to be looked at she will be turning 18 so wont be exempt, could she not continue paying as she does and ask for a refund for the time she was paying when she shouldnt ?

    I emailed the benefit department shortly after starting this thread. They phoned me today to discuss sams situation. very helpful lady has applied the exemption over the phone. I asked her to send a cheque for the money sam has paid so far, she said it would just be taken off of the total anual bill when she turns 18. Feel this is unfair as sam shouldnt have had to pay it anyway. and because she is short of money, we have had to lend her 200 quid for her rent (which we cant really afford) raised this point with the ct dept and they said for sam to write in requesting moneys paid to date, lady said that it is unlikely as she did put me on hold to ask the question to the relevant dept. GRrrrrrrrrrrr . On the plus side she did a calculation on housing benefit and looks like sam will get about £9 a week towards her rent but no ctax benefit only the single persons discount. she has set the account up properly now to take effect from her 18th birthday.
