B&Q Bathroom Installation Problems

Guys
I bought a B and Q bathroom (fitting and install) in 2011. I believe that they were having fitting availabilty problems and it was eventually installed 8 months late, it wasnt without its problems (had to sort out another electrician, personally, as the BandQ one didnt turn up etc) but all doable.
It was fine for about 8 months but then I noticed the tiles started to lift and crack, long story short the fitter hadnt correctly fitted the toilet and (behind a cabinet) it was leaking. Eventually the whole bathroom had to be replaced as it had destroyed the floor and a portion of the walls (after a fair amount of arguing) at the start of 2013.
Unfortunately last week, the waste system on the bath failed and more unfortunately as the bath was being poured. This again was hidden under the bath and proceeded to leak a fair amount of water into the flat below as the tiles didnt run to the wall. Now BandQ have, to be fair agreed to replace and fit the waste system however they have indicated that any damage should be covered by respective insurances and they are not liable. Is this the case ?
