Appeal Rejected by Issuing Company - Please Help

I was recently issued a parking charge notice and sent the company the following letter (I have omitted some parts to maintain my privacy):

Dear Sir or Madam,

I am writing in response to your ‘Notice to Driver’ and ‘Notice to Keeper’ messages for the parking charge notice issued to me on <<date>>, which I believe is unfairly issued and disproportionately expensive.

I was recently a resident of <<address>> (adjoining the car park in question) and was previously unaware of any management arrangements to control parking at this location. Indeed, as a resident I was even unaware that parking permits can be obtained for this location. This is compounded with the fact that the signage for the car park in question is not clearly displayed and is unlit at night (see photographic evidence attached).

On <<date>> I parked in the car park at <<address>> early in the morning when it was still dark. I did not notice any signs about leviable car park charges. As a result of this, I was astounded to receive a £60 parking charge notice, which I hasten to add is considerably more than a days’ worth of wages for me. This charge is so extortionate that I believed it to be from a fraudulent company and consequently I did not seek to contact <<company>> after receiving your ‘notice to driver’. In addition, your ‘notice to driver’ states that the charge increases to £100 after 14 days which is inconsistent with the £120 requested in your ‘notice to keeper’. In any case, I believe that the above charges you have requested are extortionate and far exceed the cost to the landowner for the time I spent parked at <<address>> (especially since, as a former resident, I am well aware that this car park rarely exceeds half of its capacity).

For the above reasons I appeal for the removal of all fines to me for parking in this location.

Figure 1: There are no signs at either entrance that mention that this is a private car park in which fees can be levied. In addition, the fact that the car park is permit holders only is not made clear.

Figure 3: This shows one of contractual agreement signs. While ‘Private Parking’ is clear on the sign, all the vital information about the charges that can be levied is detailed in extremely small text and no efforts have been made to draw attention to it (no colour or bold text or underlining).


The company have replied in a letter saying they cannot cancel the charge and that as a 'gesture of goodwill' they will drop the charge back to £60 for a further 14 days or I can appeal to POPLA. In this letter they had a few pictures of my car from the day I parked, showing some of their 'private parking' signs in the background (while you can see the signs in the photos, you can't actually read them!).

I really need advice as to whether I should appeal to POPLA or just pay the charge?

    Yes, all except the one that suggests the car is stolen.

    I'll ask again though as it can change the advice on wording, which PPC are we talking about ?
