They still need to all sign before a notary to say the sale has transferred and the deeds (escritura) updated, otherwise the sale is not legal. They can't do it with no paperwork.
We sold our house privately (i.e with no agent) but still had paperwork.
If they mean that they are just going to accept the money and not sign anything, or just give a receipt, then that sale is not legal . The person who has paid the money will not legally own the house. It HAS to be signed before a notary and for that there has to be paperwork.
They do not need to use a solicitor, but they do need to use a notary.
It all sounds really dodgy. I would walk away if I were you.(AKA HRH_MUngo)

They weren't saying about me not signing paperwork to be stamped by a notary here in the UK but they were expecting me to accept all their suggestions without question. They certainly were expecting me to take their word on the state of property prices in that part of Spain. I still feel that they did not do the best job in seeking a buyer, they aren't internet savvy from what I get so only relied upon word of mouth with people they know (the nephew knows). I am now waiting for tomorrow, Monday, when the nephew promised me he would send me an email with copies of everything attached for me to look at before receiving paperwork via post. I have NOT confirmed with him that I am going ahead, only that I would read it all and take advisement. IF he ignores my request and only sends it all by post, then he will have to wait as I need to seek proper advise and as it stands only one of the sellers (my stepmother with her nephew acting for both of us, in spite of me not agreeing entirely with this) has promised the buyer that the flat will be available for her to move into next month. I will not sign anything until I am 100% sure that firstly this is all above board and secondly that this is for the best.
