Please help- Accident
Hi,
I was stationary on the left side of the road, with indicator on to turn right.
I was awaiting oncoming car to pass, before turning right.
As this car passed, I turned right, and hit the car behind it, which was being TOWED by the first car with a rope about 12 feet long.
The towed car did not have its Headlights on, but had it's sidelights on.
The road did have street lighting, but was still very dark.
There was no way for me to see the towed car, neither the towing nor the towed car had its hazard lights on.
Who's at fault? please help

I am thinking still you I'm afraid "due care and attention"
It's your responsibility to ensure the road is clear before turningEx forum ambassador

You. You were the one carrying out a manouvre and therefore it is up to you to ensure it is safe to do so. In this instance I very much doubt you can claim the other parties are somehow liable.
Were there any witnesses?0 -
I agree with Browntoa, however I'd certainly be letting the insurance company know that there were no lights etc on the towed vehicle.

What was the speed limit of the road?0 -
Hi,
The car had its side lights on, which were very dim, dimer than usual (probably reason it was being towed). It did not have its headlights on.
Speed limit was 30mph. normal city road.0 -

You MUST
ensure all sidelights and rear registration plate lights are lit between sunset and sunrise
use headlights at night, except on a road which has lit street lighting. These roads are generally restricted to a speed limit of 30 mph (48 km/h) unless otherwise specified
use headlights when visibility is seriously reduced (see Rule 226).
Night (the hours of darkness) is defined as the period between half an hour after sunset and half an hour before sunrise).
Laws RVLR regs 3, 24, & 25, (In Scotland - RTRA 1984 sect 82 (as amended by NRSWA, para 59 of sched 8))0 -

It seems the car you hit did have lights on! (You refer to them as "sidelights")
If it wasn't being towed you would seemingly still have hit it!
All your fault for not making sure it was safe to turn!0 -

My mistake entirelybut thanks for the helpful reminder of the Highway Code. Dunno what I'd have done without you pointing that out.

The first car went past.... and the next car (even if there was not a tow rope) was only 12 foot behind and you attempted to turn right in between them.....
The second car was defo there, you just did not see it.
