I really do not understand why people get so hung up on this contrived tenancy business.
The rules are quite clear. If you google Housing Benefit and Decision Makers' Guide you will see that a contrived tenancy has to have been set up to take advantage of the benefit system.
From what the OP has says this is just not the case. Coupled with the fact that there is no suitable alternative accommodation for the mother from the council and the OP has spoken to the council I believe there is a very good chance that this would be allowed.
If the mother found alternative accommodation in the private sector then HB would, presumably, be paid anyway.
The OP could let his property at a far greater rate to someone else and make more money but he has chosen to help out the mother.
I cannot see how anyone can have a problem with this as regards 'tax payers' money'.
The OP just wants to cover his extra costs and will be paying tax on the small rental income.
What the OP needs to explore is whether he could get a Buy to Let mortgage if he rented to the mother and other issues concerning his mother living there - what would happen if he needed to sell up for example?0
