Capital One PPI reclaim success

I recently used the template to make several applications to reclaim mis sold PPI on several credit cards which I no longer have. I didn't have records of account numbers or statements. Capital One were the first company to respond, and I have made applications to Smile, (co-op) and MBNA as well as others. Capital One sent an offer with premiums plus interest minus tax within 3 weeks. I sent my signed acceptance back by return post. Success? Yes, except I have not received the cheque yet. This is now 6 weeks later. As for the person who posts as Moneyineptitude, please don't be put off applying to Capital One. I didn't even have to use SAR. I simply filled in the form; stated 'unknown' for information I don't have anymore; and trusted it would be processed fairly. Just make sure your reasons for describing why you feel it was mis sold are clear and accurate. Good luck!

You dont need to use a SAR with anyone. That is just an internet myth.
Capital One are generally well regarded in respect of complaint handling. The FOS reject most of the Cap One complaints they get referred which indicates Cap One deal with the majority fairly.
The time between complaint outcome and refund can be a couple of months.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. I am currently waiting for the Ombudsman's decision on a claim. Adjudicators have upheld my claim twice but capital one have asked that it goes to ombudsman. That was in April 13. Does anyone know how long it is currently taking and does anyone know what the success rate is in this type of situation?0

There is no timescale I'm afraid. Capital One complaints are generally not upheld by FOS, so if you win you will be in the minority.0

Hi we originally claimed and cap one rejected the claim last June, we filled in the financial ombudsman form and had a letter 2 weeks ago sating that 'due to their involvement, capital one would be making an offer of compensation although This could take up to 8 weeks,' was absolutely made up but then reading on other posts tho it looks like this could be refused by cap one and referred back to the fos. Does anyone know if this is true or if not has this happened to anyone and have they had offers from cap one after fos rules in their favour and how long did it take to receive an offer? Thanks x0

There is a filter system in place where the FOS give the firm a chance to effectively payout without incurring the FOS fee. If the redress level is not large, the company may decide that paying out is the cheaper option. However, if the amount is large and they feel they have a stronger case then they can choose to not pay out and let the FOS decide.I am an Independent Financial Adviser (IFA). Sorry for sounding stupid but..... Even though the financial ombudsman have said that cap one will make an offer, there is a chance that they won't? Will the financial ombudsman have been told by cap one that they will or is that just their recommendation? Thanks for your help :-)0

Don't worry, I had the same letter from Capital One, they took 7 weeks to send out the offer letter with the breakdown then another 2 weeks to send out the cheque.
Congratulations on your win.0 -

It is unlikely the FOS would say that they "will" make an offer when they will not. The key is in the wording.I am an Independent Financial Adviser (IFA).
