ppi claim from 1999

My ex and I both have ccjs from 1999, part of the amount is ppi plus interest.

I only discovered this in 2009 and would ideally like to get rid of this debt for good and wondered what my chances of pursuing a ppi claim are at being successfull.

Has anyone done this?
April 2013 - £25771.75. DFD October 2022!
April 2014 - £18146.35. DFD June 2020!

  • The lender was first national, we were persuaded that ppi was necessary but I didnt fully understand the implications of being charged variable interest for 10 years for these payments. Nor did I expect they could secure a ccj for non payment.

    PPI and variable interest are two different things.

    Your lack of knowledge or understanding is not a valid complaint reason. Its a bit like ignorance of the law is not a reason to break the law.

    Any debt you fail to pay can have a CCJ lodged against you if the person/firm goes to court, wins and you cant agree a repayment and the court decide it for you.

    Unless a loan says fixed rate then it will be variable. There is usually a risk warning or explanation in the terms. Although not many read what they buy.

    Being persuade to buy the PPI is not a valid complaint reason. A salesperson is allowed to persuade you. There has to be a wrong doing. And the evidence available has to show that wrongdoing was likely.

    I don't think they were regulated then either, so your complaint may be dismissed by them.

    Correct - there was not even voluntary regulation in 1999.

    A complaint to a court would probably fail and if it is more than 15 years since you signed up they can use Section 14B of the Limitation Act 1980 to have it dismissed anyway.

    Do you mean first national tricity finanance ltd? If so, then Santander Cards are dealing with their ppi complaints. if they reject it, you might be able to refer it to the underwriter Genworth. Any redress goes to unpaid debts.
