I haven't had dealings with them but from what I've read in other posts a lot of the time it is an old debt they are trying to track you down for (or might just be someone as the same name as you). If they do get in contact about something there are letter templates on here you can send them before you admit you owe anything, what ever you do don't acknowledge that you owe them (or anyone else money) until you have done these letters or asked for more advice on here as they might be being cheeky, just don't get scared no matter what they threaten as the law is on your side in this case, well initially at least.Official DFW Nerd Club - Member no. 234 Proud to be dealing with my debts I love the Dave Ramsey podcasts. Absolutely right Bobby. As already said they are scum! They started harrassing me for a so called debt from 13 years ago. One women told me I should remember all my debts and be responsible and pay them..mmm..so you can make a commission then? They did one with me only after I threatened them. They realised they couldn't bully me. Sad many will just give in and pay debts to them that are over 10 years old and I suspect many won;t have a clue what for.0 -

This is exactly how these 'scum' make their living. Whilst a creditor, or their official agent does have the right to pursue debts, regardless of age, they should not rely on the ignorance of the creditor in regard to the Statute of Limitations Act, which states that if a creditor has not acknowledged, in writing, or made any payment to, a debt for a period of 6 years, then that 'debt' becomes statute barred, and can no longer be 'collected' if the debtor refuses to pay.
It is ALSO against the OFT guidelines for a Debt Collector to continue to press for payment after a debtor states that he/she will not pay as the 'debt' is covered by the 'Statute of Limitations.
I know that some people accuse me of 'getting on my soapbox' about Debt Collectors and their tactics, but these people are making fortunes out of ordinary people's ignorance of their rights under the law. It is only through forums like this, that we can make people aware of their rights.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Phew - glad I'm in safe company - just received a letter from mh trying to trace me. As curious as I am I phoned and was asked to confirm my details - which I did for the address they sent the letter to (now a bit worried about doing this but that's just me) but was asked to confirm if I lived at a previous address - I denied - they gave me a wrong address to confirm and I asked what it was about. They refused to tell me. I then checked me credit report and though and behold - there is an entry for a mobile phone company that states a debt (more below) ends on, you guessed it next week. This debt was actually due to identity theft and my bank has acknowledge an error had been made and reimbursed all incorrect monies.
My question, what do I do?
I now have mh searching for someone to pay the debt, they have my address so will they now try and recoup losses through me, even though I can prove to them the debt is not mine?
Should I have to prove it was identify theft to them? Which I can but am reluctant to enter ionto any correspondance for fear of future reprisals.
Why is a phone company selling their debt to mh even though they know it was set up falsley under my name and the banks have acknowledge an error in the direct debit system?
I am now very paronoid - worried and starting to get stressed about an issue I resolved about 6 years ago. I comforted by the fact that debts are 6 years statuted barred but I still have 7 days to go before the six years is up - and it's not even my debt but still, I'm worried!'Proud To Be Dealing With My Debts' : Member number 632
