Westford and welldale?

Don't know if this is in the right area, but has anyone else received a phone call from a company called westford and welldale? Apparently the way companies have set up direct debits with consumers has resulted in billions owed to consumers.. The website is westfordandwelldale.com I was on the phone for a good half hour with an advisor called James and he said the list given to the company by the uk financial services contains the details of people that are DEFINITELY owed money, (he knew my name and address anyway) . Here's the email I received after the call:

Hi Kurtis,

It was good to speak with you. I can confirm that you are guaranteed a direct debit rebate of some form, however I am unable to provide an exact amount at this stage.

I just want to confirm that no upfront payments are required at all; it is all done afterwards on a no-win, no-fee basis when you have the rebate owed to you actually in your account. Also let me assure you that we will never ask for personal banking information.

You may of seen it yourself in the press, it was mentioned within the financial industry when all of this first came to light. However the banks and companies are keen to cover this up as you would expect.

Therefore if you have not heard of this scheme I would strongly suggest viewing a couple of the articles written by using the following link and if you see any more please forward them to us. The Telegraph have recently written articles on this matter.

There are over 32,000 companies, who within the last six years, have been setting up direct debits outside of the correct procedures. Anybody who has paid these companies by direct debit within that timeframe is therefore entitled to compensation in the form of a rebate.

These companies include credit card companies, mortgage companies, loan companies, gym’s, utility companies and mobile phone contracts, in fact if you have paid anything by direct debit over the last six years there is a high likelihood you are owed some money back.

    there is no such list. That is a common lie with scams.

    No such thing. However, this is a relatively recent scam that is costing people thousands. We have seen several victims post on this site in the last few months.

    Don't fall for this scam. The banks have to refund if you query a direct debit. However, they dont just refund and leave it there. They contact the originator to ask for evidence of an agreement and confirmation the payments were correct. Once the firm provides that to the bank (which takes about 4-8 weeks) the bank will take the money back out of your account.

    However, by that time, you would have paid the claims company your cut of the initial refund and be thousands out of pocket.

    It is a fraud. Dont fall for it.

    They have a section for their reviews and one of them is from this forum, and yourself, are on it. There is a person asking about this company and you say you are unsure about it and then a couple more people say how good it is and you said you have done your research and it is a huge company in Germany. To me it looks like a doctored web page, could you confirm this? That link to the media part of their page can be found in that email. Thanks

    You're correct it is a doctored web page as is the Daily Telegraph link also, stay well clear of this company

    They have contacted me also, told me to do an indemnity claim against northern rock for 3000. They said northern rock agree to pay me compensation hut said it would take 120 days to process so give permission to do an indemnity claim to get it back quicker. How they discussed this with NRAM without my account number ect i do not know! I rang bank to do it n the bank asked lots of questions and said the indemnity team would contact me within 48hrs. Think they think something is wrong too n not put it through. Told phillip westford who seemed anxious n that that had never happened before...anyway started doin research as felt something wasnt right, rang a solicitor and financial advisor who both said theyd never heard of that scam but of similar. I emailed peter welldale with my concerns & he took more than 12 hrs to reply. Said he wasnt a scammer and that philip is goin to ring later...i emailed the journalist on the telegraph article n he said he didnt write it and that the site must have been hacked and hes going to investigate. Ive spoke to 5 different people at westford and welldale so this isnt a conartist working alone, would a firm really try and commit fraud on such a scale??

    It is not compensation. This is a lie and part of the fraud.

    The direct debit guarantee scheme requires your bank to refund the money if you say the collection was wrong. So, think about it for a moment. Do you think the bank just refund the money and leave it at that? no. They will contact Northern Rock and give Northern Rock a period to show the payments were correct. Once Northern Rock show the bank the direct debit mandate and confirmation they notified you of the amount then the bank will take the money back off you.

    If Northern Rock have breached the direct scheme (highly unlikely) then you still owe Northern Rock the money. You then destroy your credit record and likely find yourself in court if you cant repay them.

    There are loads of cold calling scams going on at moment. These companies set up with limited liability. Scam for period and then shut down and phoenix under a new name. The authorities are too slow to keep up. The current system works on the basis of volume of complaints to the ministry of justice. Until a firm gets a certain volume of complaint against it, it doesnt really make their radar.

    I did not fill a dd mandate in, this is how they are saying they broke the rules. I paid by card for 6 yrs then set dd up over phone 1 day after payin by card. Westdale is claiming that nram broke the rules by not sending a mandate...the solicitor i rang said it sounded feasible but why should i pay someone 36% to tell you that?!
    Independent financial advisor said sounds like a scam but couldnt be sure as we have a blame culture & maybe they are taking advantage of this loophole?
