Popla appeal failed - what next

Hi all. I'm back again and after some advice.

Back in December, my granddaughter's Popla appeal was not registered as, due to personal circumstances, she missed the 28 day deadline.

However, since being informed of her appeal not being registered, she hasn't heard anything from Vinci who levied the original PCN - no mention of court proceedings or correspondence of any sort.

Is it out of the ordinary for things to take this long or is there some kind of terrible surprise awaiting her? I imagine that it can't have just gone away (can it?)

Is there anything she can/should do in this position?

Thanks

nothing she can do apart from wait 6 years for the statute to run out (a claim via the small claims court service)

6 months is nothing in this "game"

you will see another thread on this page 1 today asking about a pcn going back to 2012 which is being chased up by debt collectors, so no court action yet on that one either
  • Six years! Good grief, I had no idea it could take that long.

What's likely to be the next thing that happens then (even if we don't know when that's likely to come)?

With Vinci, the next thing is likely to be that 6years will pass. However, PPCs do change their tactics from time to time so nothing is guaranteed.

That's covered in the NEWBIES thread about debt collector letters, and in the other stickies hosted by Crabman which includes pics of the PPC letter chains to ignore (both top threads on this forum for newbies to read first).

Obviously it's the bog standard 6 years as that's how long any consumer/firm has to sue over anything, such as if you bought faulty goods (same thing) the 6 years is not a parking law or anything like that.

Most letter chains die out after a year. It's no biggie, we all collected them all the time before POPLA existed!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I think the Legal situation needs pointing out.

In the UK anyone can create a alleged debt in this case it is a parking charge.
I could create a forum reading charge and claim by reading this you enter in to a contract to pay me 4 jelly babies.
In short anyone can then sue anyone for anything they like.

The problem starts when they go to court and have to prove this charge, which if the claim is defended correctly, they are usually and groundlessly beaten and the claim defended.

They use and abuse this right to intimidate, scare, frighten and bully.

As with all bullies you stand up, do not give them your money and if they decide to waste the courts time you hit them back hard.
    Be happy...;)

You also had the option of paying two jelly babies if you paid it early but why would you do that?

Listen to the advice on here .... And keep your jelly babies all to yourself.
