charge from CP plus, roadchef taunton deane north services

Hi - i know there are a million threads on here about these s.o.b's but ive now had a second letter from cp plus about my having overstayed in the car park on 29th march. i used a template that i found on here somewhere to appeal it only 3 days later ( i got the first "charge notice" within 72 hours of when i'd been in the car park) saying that i wished to appeal due to the various generic reasons i found on here to put, sent it with proof of posting.....but today theyve written to me again, now saying i have to pay £90 instead of the "discounted" amount offered for me to pay in first letter(how kind of them) - i also wrote i was only in that park due to being taken ill (i've got crohns) and had no idea there was a time limit in such a park at that time of night (i was there from 10pm till just after 2am!) - they clearly have ignored this letter as its not referred to. now, do i just ignore them (i did say in first letter that i wouldnt be contacting them again, as per the template i found on here) or do i need to do something more? i really thought my appeal letter would be end of it. all rather vexing when im currently unemployed and broke! i have no intention of paying it obviously, but if anyone could point me in the right direction thread-wise as to what to do next i'd be v grateful. i find this forum v useful at this time with my job/law/debt worries, this is just another ruddy thing to worry about! thanks :beer:

  • ps it says i must pay or challenge its issue within 14 days - im wondering if i should just send the same letter again, mention that this is 2nd time ive sent it, enclose a copy of the proof of posting of the first one,send it recorded delivery and tell them i wont be paying it again ?

    post ]2 sounds reasonable to me, ie:- to write saying you have already appealed it, so cancel or issue a popla code

    the fact that they have not done so means you should also follow the action of complaining to the BPA as well (detailed in that NEWBIES thread)

    neither have you mentioned complaining to the landowner to get a cancellation , which clearly you should also have been doing


    my point ?

    why are you only pursuing one course of action when more are open to you ?
  • i only did the one thing as i'd only had the one letter. i knew i had other options, but i didnt think they'd actually contact me again. i knew i shouldnt just ignore it as the rules had changed recently.....thanks for the tips. i will need to find out who the landowner is, then. i read about popla last month after i got the first letter. i know cp plus are registered with the parking people so i know that's a dead end. wish i'd never stopped at those damn services, i didnt see any signs and wouldnt have thought i'd even have to pay at that time of night anyway, there were only 3 cars in the entire place!

    doesnt actually matter what happened or how empty it was, the rules are designed to entrap motorists into having to pay exorbitant demands and they will use any excuse tio extract the money from your purse or wallet

    good job you didnt use the moo-male word and only the mild s.o.b. acronym :) (dont wanna upset the admins , lol) - I would use the term shyst*rs myself or maybe we need a new word for them after considering all the ones "banned" by the mse sticky thread !! lol

    the rules didnt change recently, but the law actually changed over 18 months ago (oct 2012) and the advice on here changed in feb 2013 so about 14 months ago

    popla is never a dead end if you word your appeal correctly and this forum has hundreds of successes at popla listed in the POPLA DECISIONS thread , including one of my relatives that won there

    so in future , appeal , dont ignore - all ignoring does is bring it down upon you at a later date

    Calm down - I am just helping a friend in a similar case with CP Plus where no signs were seen and there is nothing to worry about - she is about to win at POPLA (I know she will!). You don't need to find out who the landowner is - if you appealed you should get a POPLA code, end of subject! You are saying you sent an appeal - so write a complaint email to remind them (CP Plus) of their obligations to provide a POPLA code with the rejection letter and copy in the BPA to the email as it's a complaint about a breach of the BPA Code of Practice:

    Not sure why you think you are at a dead end - you are the same as plenty of posters - you appealed but they ignored it so complain & get your POPLA code. Happens all the time.

  • thanks! no i know i'm not at a dead end.... i had thought of emailing them instead, it would save time and money. i'm going to try and get something mailed off today either way.
  • got an appeal acceptance letter from CP Plus today :beer::j:T thanks to everyone on this site who helped me both this month and when i got the first letter. this site is ace!!
