Ive claimed charges back for my mum from both a bank and a credit card but they settled long before court, I gave a friend the template letters so he could do it too (this was months ago)
He rang me recently to tell me he has a court date and is absolutley bricking it because he doesnt know what he is doing and needs help and with all the stuff going on with cases being lost/thrown out I dont know what to tell him for the best??
Can someone help me please?

but unless you know the ins and outs of the case can't really help any further but he will need to print off the above court bundle.0 -

The next step is to start getting his court bundle up together. This is basically three copies of everything he should already have: his list of charges, his letters to the bank and any letters from the bank. Depending on the actual defence, he might need some other more legal documents.
Please read the Court Bundle Checklist and Reclaim Bank Charges Help threads for information and the Reclaimed Bank Charges Success Stories and Reclaimed Bank Charges Success Stories II threads for inspiration.<O:p</O:pThe acquisition of wealth is no longer the driving force in my life.

Hi
Had a read through those links (going to have a closer look later) first thing I noticed is you have to send the paperwork you will be relying on to the court and the bank no later than 14 days before the hearing, considering his case is going to be heard in 8 days, has he screwed up??
He has brought me all the paperwork he has had sent, but I notice there isnt anything stating the court date on, im assuming they would have sent this in a letter and would it have told him about the no later than 14 day thing?Good enough club member number 140 -
The letter giving a court date would have in it exactly what kind of hearing it is, the date and what information was required, so yes you need sight of that letter.0

Gonna try get in touch with him re the missing letter.
What happens if he has missed the dead line for sending the required infomation??Good enough club member number 140 -
All might not be lost.
Advise they contact the court to explain if they have missed date to file documents.
However, the bank should also have filed their docs with court and served your friend with a copy which you can pretty much guarantee they haven't.Gonna try get in touch with him re the missing letter.

He has brought me all (or so I thought) the paperwork he has had sent ive got...
Notice that acknowledgement of service has been filed
Notice that a defence has been filed
A copy of Allocation Questionnaire filled in by Kirstie Ann Ross (of YB)
The defence that has been put in by Yorkshire BankGood enough club member number 140 -
Just found out that it is a preliminary hearing, Is this bad news? because ive just looked it up and it says it could be because the judge wants to explain 'special directions' in person to both parties or the judge feels there is no point in a hearing....
Does also say the case could be settled, struck out or will proceed to a full hearing and judge will issue directions.
So maybe there are no directions on the letter I havent seen yet.Good enough club member number 140
