Please could someone help
I bought a samsung washing machine foolishly from Currys store,(I should have learnt from past dealings with them!! :eek:but I was desperate to get a new one before the Easter break and a hospital op. Last week.
The washing machine became faulty 2 days after buying it. I contacted Currys, who told me it was nothing to do with them and to contact samsung. I contacted samsung call centre who advised me that as I had contacted them, I could not return the machine but that they could send an engineer to fix the problem.
An engineer came out and verified that there was a fault and informed me that I could return it back to Currys if I chose, but as I could not face taking the 7kg machine back to store I agreed to have it fixed. The engineer came back a week later-today. He left after 15 mins approx and the machine is still not working properly, the sensors keep sticking..something to do with the machine believing it has water leakages, so the engineers states?
Please could someone advise
1. Is it Currys who I need to be speaking to?
2. Even though I have had the machine so called repaired does the SOGA still apply to me?
2. Am I responsible for taking it back to the store. I had to pay someone to help me take it home and to fit the washing machine, as I said I was desperate at the time to get a working machine!!
I paid £399 and bought it on the 17th April.
Really disappointed and frustrated
Thanks

Currys were wrong, if they sold you the machine then it is them you have a contract with and them that have an obligation to offer a remedy if it does not conform to contract. It's often quicker and easier to go directly to the manufacturer but they shouldn't pretend that is your only option.
Since it failed so soon after delivery then acceptance has probably not occurred yet so you have a right to reject it for a full refund under the Sale of Goods Act if it is inherently faulty. Accepting the attempted repair does not mean you lose that right. It is up to Currys to prove that the machine is not inherently faulty, but it appears the manufacturer has already indicated that it is. If so, Currys need to pay for collecting the machine from your house.0 -
Thank you Frugal Mike for your quick response.
I will attempt to talk to Currys tomorrow, but I am sure that they will try to fob me off again by asking for another confirmation from the engineer that the machine is faulty!!
I do hope they collect it, this was a worry, taking it back to the shop:eek:0 -
Thanks frugal Mike:beer:
Just contacted Currys this morning and with the advise given they agreed to collect the machine tomorrow but will have to go to store to get a refund.
Really pleased with this.:j
Very disappointed with samsung who refused initially to give Currys a code for the defunct machine despite knowing that the engineer had come yesterday to fix it.
I shall stick to Bosch!!!just bought this online and with the advise of this site bought it with cashback:T:money:
Thanks:T
A new convert to this site:rotfl:I feel invincible lol...until next time0 -
When you get to the store, it might be worthwhile speaking to the manager and asking if they will cover the cost of you having to travel in order to get your refund.
You might well get a gift card from them.0 -
