Pcn help needed please!!!!!

I write this post with a little anxiety! I hope someone can help!

I was served a PCN while 'illigally' parked in an NCP carpark at a train station in Essex in December last year. I unwittingly parked in a bay that was very poorly signed "Premier Parking" which I was supposed to clearly understand as "Reserved Permit only" and it seems like many others have fallen foul at the same carpark......I've read many posts on here today, so won't bore you all too much with the story just yet, but I am looking for some advice as what to do as I have been reading/relying on old instructions that seem to no longer exist....

After first contacting NCP to tell them that the Parking was paid for via "Ringo" electronic payment (I didn't even realise at the time I sent this responce that I was parked illigally!) I received a letter from NCP telling me that they stand by the PCN because as far as they were concerned the payment didn't cover me for parking in the permit only bay and that they were confident that the signs are clear! (I disagree!!)

I then read on a forum that they didn't have grounds to serve the PCN and to ignore all other correspondance from them or their debt recovery partner (Newlyn) and eventually they will give up!.... I have ignorerd all other correspondance. (2 letters from NCP and 2 from Newlyn). The last from Newlyn saying that they were dissapointed that I hadn't been in contact with them to settle the debt and that they may take further "court" action if I do not contact them to discuss making payment.... I took this as more scare mongering and also ignored!....

However, I have today stumbled across this forum and it seems the advise I have been following is outdated and there is a good chance that they will pursue thru the courts!....

I have read up and it seems, thru reading some of the posts on here, that I can still appeal to NCP even though I have missed their date to appeal, However, the first letter I received from Newlyn stated that all correspondance going forward must be with them and NOT with NCP.....I'm assuming this is again, debt recovery agency waffle so that I don't push my case back to NCP but instead just deal with them so that they can get my extortionate debt settled?!

Could I have some good advise please as to what to do? The last letter from Newlyn was a couple of weeks ago so I assume that I'm running out of time?!

    just read the NEWBIES sticky thread at the top of the forum

    as for appeals, these have to be submitted within 28 days of the NTK , otherwise you wont get a popla code once you are outside of this deadline and its difficult to get one after that (not impossible but they dont have to provide one when you are out if time, even though they can do so)

    debt collectors cannot do anything, so read the debt collector part of the NEWBIES post a few times to familiarise yourself
  • Thanks REDX, I have been skimming thru the NEWBIES post and read a little but just wanted to get a post out for advice, mainly as the Debt agency had suggested that I can no longer deal with my issues thru NCP and that I had to go to them directly (which I'm guessing isn't true)

    It may have been a mistake on the part of NCP to give up the information, however I think that they gave me a popla code with the letter they sent me, however, I think I remember that they also stated the code would expire within a certain period! I will check this when I get home tonight!

    I'll also have a good read thru the NEWBIES post to get up to speed!!

    strictly speaking IT IS TRUE, the PPC have washed their hands of it for now and are hoping the DC can get the money from you

    assuming they cant, the DC will refer it back to creditor for further action, which would be court action if they decided to take that route (many dont , no idea about this PPC though)

    the appeal date is valid for 28 days after the NTK is sent to the keeper, then it lapses according to the rules of this (game) , meaning that after 28 days they no longer have to give you a popla code for mediation

    so I assume you did not appeal within the time scale so it went to the DC and now the DC is chasing the alleged debt

    if they dont get it , they dont get paid , hence the harassment by them towards you and what they are telling you

    a PPC can issue a popla code at any time , but they only have to do so if you appeal in time , which you dont appear to have done

    so you can ignore the DC but dont ignore any LBC or mcol court papers

    my advice is to stop skim reading that newbies thread, sit down and read through it properly , several times, as it answers all you need to know, its been honed to account for all eventualities so is pretty much fireproof now

    Yep, a POPLA code expires after 28 days from when they generated it. If you had a POPLA code and failed to research how to win at POPLA and what it was all about then you missed a trick - and will be getting debt collector letters for months now - just like we all did for YEARS before POPLA existed!

    Please read the NEWBIES thread post #4 about debt collectors (**bites lip to stop saying anything much about how tedious endless stuff about ignoring DRP letters is...yawn** sorry). It's already covered in the NEWBIES thread so the forum doesn't get clogged up with people reporting each and every debt collector letter when they are already shown in the sticky thread by Crabman as well as being summarised in the NEWBIES sticky that they can be ignored as they always were before POPLA.

  • Thanks again, will read thru NEWBIES thoroughly when I get home! Will also check for that popla code as I'm sure I did receive one! They may have had to issue it as I did initially appeal the PCN online when I told them that I had paid for an electronic ticket!

    I will take this as far as I need to go to thou to avoid paying as the £260 that DC is trying to recover is at best immoral and extortionate for a genuine mistake, whether I appealed in time or not!

    I would rather go through the small claims court process and take my chances than pay some DC £260

    You don't need to take it anywhere, just collect the letters and next time, appeal to POPLA with our help as it stops all the threatograms & gets the stupid fake PCN cancelled. NCP do not try court but keep all letters & evidence in case they change their mind within 6 years of course.
