Samsung repair - what's my right?

Hi i sent my phone (S3) in for a repair , faulty usb connector , which was fixed.

When it came back i had a fault with the bluetooth not working, working fine before it went in. So was not happy that whilst in the possession my phone had developed new faults.

So sent it for a 2nd repair, came back not fixed.

Said would not replace at this stage , need to go back for a 3rd time, which i sent yesterday

If it comes back faulty again ( which i hope it does not ) , can i demand a replacement ?

They tell me its a repair warranty only , but surely they can not keep sending a phone back not fixed.

i was under the assumption, that they have a reasonable amount of time and attempts to repair the item, if they can not , they have to replace , is that correct?

my phone is 18 month old , 1st year warranty with retailer, 2nd with Samsung directly.

many thanks

No sorry Samsung can keep repairing it.

If you want to take it further then you need to chase the retailer, not the manufacturer under SOGA.

You may have a case for rejection with a specialist report stating an inherent fault(good luck with that) but the retailer will just keep passing the buck onto Samsung, so that only leaves taking your claim to the small claims court.

The fact Samsung are agreeing to repair would probably satisfy the judge that they are indeed accepting liability for the phones faults (even without a report) so all that's left is putting a price on it to claim. You can't claim the whole cost of the phone because of the use you have had from it, so current second hand value plus costs is what you should be looking for.

Who have you been dealing with? If Samsung, then you are tied to the warranty terms.

If it arrives back faulty again, you can pursue with the retailer, however you have to give them an opportunity to repair.

I sent my tablet away 3 times and they wanted it sent for a 4th, I think they will just keep asking for it till you give up or you get a refund from the seller
