bought a phone repair - phone lost in post!¬

bought a phone repair service - sent iphone 5 away for repair.
it was sent back - recorded, not special delivery - which wasn't clear via ebay (otherwise I would of clearly paid for special delivery) and phone never received.
escalated case with ebay and they've just refunded my repair cost. just seems like the whole process is open to abuse and goes against selling policies of ebay.
I have no iphone 5, and im deep in the sh*t with the missus!
been to bank to see if I have any protection on my card, but feels like im clutching.
ebay are not helpful in the slightest, and my feeling is that the post office is a franchise, they knew what it was and the fact it wasn't covered and have stolen it - so I guess I will have go to police
any help massively appreciated.

It is the sender's responsibility to get the thing back to you.
Until it is delivered to your address, the sender is responsible for the goods.
Forget ebay... have you spoken to the repairer?0 -
Unfortunately it is the senders responsibility to ensure items sent have adequate insurance/coverage should something go wrong. You can open a claim with royal mail but your claim will be limited if you didnt use the right service/have proper insurance.

can you block the phone? sounds like a dubious scam - as most people would grasp the value of what was being sent and ensure for all parties that the item was securely insured. This should be something enforced through the contract that you had with the repairer - in terms of the extent of there liability at any time.., how reputable do they seem (is this something that happens often for them..)..0

yeah, lost on its way back to me. he gave me a tracking no. but turns out its useless to track anything. recorded has insurance value of £20
I thought the same as unholyangel - their responsibility until I receive it0 -

Surely you should be able to submit a claim by small claims court to get refunded for the lost phone.Thrifty Till 50 Then Spend Till the End
