DFS Unpaid Debt

Hi,
My mother dies last November and still owed payment from a settee she had a credit from DFS. We immediately called DFS and asked where we stand, they said the debt would most probably be wrote off but they would need a copy of my mothers death certificate, which we duly sent - 3 times. This was in January. Today I received a letter saying we will need to sell the settee and send them the money - can someone advise where we stand? Many Thanks,

What other money is there in the estate? If they say there is still money owed and there are funds available to pay it then you need to do so.
If they are suggesting selling the sofa because there are no other monies, then you still need to look at the bigger picture - are there other debts that need to be settled? They can't have their money rather than another creditor simply because there is the sofa they sold her as an asset of the estate.:heartpuls Daughter born January 2012 :heartpuls Son born February 2014 :heartpuls

Check the terms of the loan if ownership does not pass till the last payment is made then they can have all the money.
You could just tell them to come and collect if they still own it.0 -
Whoever has acted as executor (if your mum left a will) or administrator (if not) of the estate needs to make sure this is sorted out, or they could find themselves personally liable.
Were there other assets/cash and other debts left?0 -
nope not true. only if they failed in there duty to execute the will would they be responsible they can never owe dfs for a loan to another,Whoever has acted as executor (if your mum left a will) or administrator (if not) of the estate needs to make sure this is sorted out, or they could find themselves personally liable.

If the executor has given money away that could have been used to pay the debt, he/she could be personally liable to repay the debt to the level that the estate could have done.0
