    I'm surprised that you didnt realise you cannot bring a small claim against anything other than a person or private company or business. The ONS is a non ministerial department of the government. You are trying to sue the government of the United Kingdom through the small claims court for £5000 you are not entitled to. Good luck with that. :rotfl:



    Did you miss the bit where I said PUNITIVE costs can be awarded against you at the discretion of the judge.

    With regard to barristers...they can send any expert witness to defend the case that they see fit and seek costs for that witness up to £200 per instance.

    Edit...I just checked and the upper limit for expert fees is now £750 per witness as of 1st April 2013.

    Do you even think about what you are writing before spewing it out? What are these expert witnesses going to be saying exactly? I'm pretty sure a "does this witness have first hand knowledge of the facts" would dismiss any "barrister" looking to make a fast buck and I'm sure the judge would see through it too. It is a simple claim that hasn't been denied by the defendant directly. I doubt VERY much that expert witnesses are warranted.

    Not sure where the ONS as Defendant came from anyway, did I say that? Did you read the front of your questionnaire? I doubt it

    I know you would like it to be as simple as "they own the data" but frankly you are mistaken. If I hadn't applied a condition upon the provision of the personal data then yes effectively I guess I would have consented to some form of right to ownership of the data transferring to them. Perhaps like in your case. However that is not what happened in mine. Again it is merely your opinion that you attempt to state as fact.

    There is no precedent that I can find in relation to this. I am creating something new here (perhaps). For some reason it offends you and you have insulted me and seem to take pleasure in mocking me or in the thought of me being jailed or heavily fined or "nailed to the wall" as you say. It speaks absolute volumes about you.

    I never said there was an obligation on the ONS to enter into a contract with me and in actual fact at this stage I am not alleging that they have because I would have to be a mad man to believe that a non-living thing could have the capacity to enter into a contract!!!

    Do you mean I have no real prospect of success? Again, opinion. Good luck in nowhere doesn't even make sense! As I said before, think before writing.
