Hi,
I instructed a claims handler to process a claim agaianst MBNA.
After months of waiting I was written to and received texts from the claimshandler saying MBNA would not pay out and all I could do was go to theombudsman which could take 2 years.
Out of the blue I have received a cheque from MBNA. MBNA have written to theclaims handler and the claims handler now wants full settlement for their fees.
I feel the claims handler should beentitled to all if any of this compensation considering they told me there wasnothing they could do.
Any advice here would be very much appreciated.

Your feeling is wrong, they did the legwork so should be paid according to the contract you agreed to. If you didn't want to pay you should have made a claim yourself.0

Out of the blue for you but not behind the scenes. The FOS gives firms a chance to pay out without incurring the FOS fee. So, its common to get money before the adjudicator takes a look at it.I feel the claims handler should beentitled to all if any of this compensation considering they told me there wasnothing they could do.
They did the only thing they could which was refer it to the FOS.
You were the one that employed them to put a stamp on the envelope. yes, they do very little but you knew that at the start. So, nothing has changed.I am an Independent Financial Adviser (IFA). I know your stance is not to use these companies but due to my busy schedule. They contacted me in early April saying my only option was to go to the ombudsman.
I have not gone to the ombudsman.
Hence, the payment came out of the blue last week.
I know they have done the paperwork and I have signed the documents. I know I am banged to rights but just thought there may be experience on here of arguing a little reduction.
If you don't ask, you don't get.
