mysmartbuy.com

We purchased a Lloytron L8511BP floodlight, with a long life led, in February 2014, and has now ceased to work April 2014. It's not one that the LED can be changed, so now the unit is useless. I have looked for the web site and I discover that mysmartbuy.com have gone into liquidation. £29.99 was paid for this item, it's not a huge amount in the grand scheme of things, but it a lot of money for nothing. We contacted Lloytron, the manufacturer, but they say the guarantee is with mysmartbuy.com. What chance do we have of getting a replacement or our money back?

    Have you contacted mysmartbuy.com at the email address suggested on their website?

    Assuming you paid by card, it might be worth contacting your card company.

    Not sure that you strictly have a valid claim, but have a read of MSE's Chargeback article.

    I have a more expensive item (£59.99) gone west; have raised with my cr card coy and will advise.

    Was a (Daily Mirror Offers) item, but D Mirror have sent no response to several e mails.

    UPDATE 13/8
    Mirror Offers promised a letter re Legal remedies; not received;
    MasterCard Chargeback may be an option and have sent forms off to HSBC
    but may be too old to qualify ie bought Oct, failed July.

    I had to return £ 230music centre when it went wrong. Mysmartbuy answer machine said delay was tempory as did their web site. By the time I discovered they had gone into liquidation it was more than 120 days so my credit card company refused to refund me.

    That's that unless anyone knows better?

    I would advise you to speak to your credit card company again.

    Under Section 75 of The Consumer Credit Act 1974 your credit card supplier are equally responsible with the seller for performance of the contract.

    Have a read of MSE's Section 75 Refunds article for more detail.
    Particularly this bit:
    If the retailer/supplier has gone bust - go to your credit card provider

    Here it's clear-cut, you can't go to anyone else so the only option is to claim from the credit company. Simply call your credit provider and tell it what you're doing. Actually say: "I am making a claim under Section 75 of the Consumer Credit Act". It should then send you a claim form.

    Sometimes it will tell you it will try to reclaim the cash from the company in administration. You can simply answer: "Great news, I wish you the best of luck. However you are completely liable for my goods yourself, and I would like the full amount I'm entitled to please, regardless of that claim."
    Also note that there is no time limit on a Section 75 claim.
