Question about refund after company misdescribe item?

Hi all I wonder if you can help.

I purchased a push bike frame from a company online and it was stated that it was a large size frame.

When the frame reaches me and I unpack it it becomes immeadiatley obviuous that it is not a large frame but infact a medium. The company have agreed that this is thier fault and arranged collection of the frame.

Is it right that they should refund me before they recieve the item back or do I have to wait? its being returned at the companies expense via yodel and Im concerend that it could take a while to reach them.

Am I within my rights to ask for a refund before the item reaches them ?(it is currently en route but the tracking is saying "item in transit but possible delay")

Thanks

Steve

No company will refund before getting the item back
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

Since the courier was contracted by the seller, your duty of care for the frame ended the instant the courier collected it. If for example the frame was to go missing in transit then that would be the sellers problem and they would still owe you the money.

As far as timescales go, the Distance Selling Regulations say they must refund as soon as possible but no later than 30 days after you cancelled the contract. That effectively means they have 30 days to refund you, which should give Yodel enough time to get the frame to them first.

Amazon sometimes refund before the goods are received by them.

I recently ordered a shredder and when it arrived, I discovered that they had sent a totally different one to that ordered.
I called them up and they didn't have the correct one in stock so they issued a full refund that day and made arrangments for the wrong one to be collected.
The only proviso was that if they didn't receive the item back then they would redebit my payment card.
