Council PCN: Issued ticket but 1 minute prior I'd paid via Ringo for a parking sessio

Please can I get some advice about a council PCN challenge that has been rejected? I paid for my parking remotely via the Ringo service one minute before the time the PCN was issued. So when that ticket was issued, my car was covered (albeit for only a minute). So presumably the council doesn’t have a leg to stand on? It seems they have not read my challenge fully and just assumed I got the ticket as I accidently paid for my old car. There’s a bit of a backstory – here’s the e-mail I sent them in the first place:

I am in receipt of a PCN reference: XXXXXXXXX issued on 04/04/14 at 15:39hrs on London Road. I write to challenge the PCN on the basis that I made reasonable endeavours to pay for parking in accordance to street signage and I have objective proof to support this case (see below).

My second ground of appeal was that at 15:39hrs my vehicle was covered by a payment made via Ringo.

As I parked my car I had intended to initially pay for parking with cash – however approaching the ticket machine, I was surprised that it did not accept 10 pence pieces.
The only other coins I had were one pound coins but the machine didn't give change.

Seeing the ‘Ringo’ sign on the machine, I decided to pay that way instead.

I walked back to my car where my phone was. I'd paid previously using the ‘Ringo’ app, but I hadn’t used this service in a while and in the meantime I’d had my debit card replaced.


The app defaulted to my old car registration, so I changed details to my new car and proceeded to payment. I noticed that the app still had my old debit card details and so I deleted them and added my new debit card details. This process has already taken several minutes so I was getting flustered and to add to this two traffic wardens were approaching. It was at this time, unbeknownst to me; after re-entering my card details, the app had reverted to using my old car registration. (I had made payment of 20 pence for 15mins).
Whilst shopping I kept an eye on the time and shortly before my 15mins were up I again used the app to renew my parking. It was only after making this second payment that I notice the app had previously defaulted to my old car registration! I quickly again changed the details of my vehicle registration and paid for another parking session (both of these payments; the extension of the first session for my old reg and the new session for my current reg are illustrated in a screenshot of the app from my phone).

Attached is a screenshot of my phone showing the two sessions. The exact times of each of the three payments were obtained from my bank: Payment 1 15:23hrs / Payment 2 15:37hrs / Payment 3 15:38hrs. I believe this information would also tie in with the information held on your own payment systems. So at the time the PCN was issued, I had paid for parking. Further to this, I’d infact had to pay for several parking sessions due to what I believe is a fault with the payment service (app) which you operate.

I can provide proof that I sold Bxxxxx in May 2012 if required. I can obtain written information from my bank about the times of the charges, but this may be chargeable or at least require some time (they gave me the exact times the payments were made over the telephone)

I hope this will prove my case and therefore the £40 ticket can be disregarded.

    I suggest you repost this on www.pepipoo.com as well as they are experts in council ticket PCNs, they will need to see both sides of your PCN to help, so take a scan/photo of that, redact personal info and use tinypic.com to host the images, then place the links in the new thread you create in the council forum.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.
