Screwfix Bathrooms non-delivery

Hi,

I ordered a bath and associated accessories from Screwfix Bathrooms weeks ago with a delivery date of 19th April. However, when it arrived the bath had a scratch and I was advised not to accept delivery by the driver as it was faulty (he also noticed the scratch) so that is what I did.

However, they then re-arranged delivery for today at which point I mentioned my OH would have to take the day off work and yesterday I received a text with the times it would be between.

I have just received a voicemail on my phone telling me they would no longer be delivering today and that it would have to be tomorrow

OH has lost a days holiday and overtime money so needless to say is not pleased. We have spoken to them (at a cost of 20p p/m!) and told them to cancel the whole order and collect the two accessories that we kept from the first delivery.

However, my question is: should we try to claim anything from them as we are now out of pocket and have to delay the bathroom fitting even further while we find and order a new bath :(

Yes, that's what made me wonder but I don't know where I stand in the case of the first delivery arriving but being damaged and now that I've cancelled the order completely?

Maybe I should just send off the template letter and see what happens?

So you've cancelled it, and are wanting compensation?

Never going to happen. You have not given them the opportunity to rectify the situation.

No I cancelled it after waiting in for it twice, once when it was damaged and once when they just decided not to turn up. I gave them the opportunity to rectify it today.

No, the opportunity to rectify was when they said "We will deliver tomorrow". Had you agreed, then you could seek recompense according to the above article. But by cancelling instead, you have now ended it.

Your only recourse would be their goodwill, which I doubt you will receive as they have no incentive to offer it
