My company are actually backing me on this with regards to her treatment. Was more looking for legal help - 'your on a hiding to nowhere' isn't quite what I've been told. Can you substantiate on those claims while being a little less 'look at me, I'm harsh'?
You are embroiling your company in an issue that is nothing to do with them. They employ agencies for a good reason - one of which is to keep these sort of arguments at arms length and something for the agency to deal with.

But that is a risk that anybody working in the warehouse would be confronted with.

I question the risk assessment that was done if they have raised this concern for one person and it had not been identified before. If that is considered an unacceptable risk then that warehouse needs shutting down until mitigation has been put in place.

Heavy lifting is understandable. I don't understand the comment on being trained on heavy machinery. If she is using that to move heavy bins then she is not doing heavy lifting. Your attempted expalnations of the risks don't make sense

That's because they don't make sense to me, either. Heavy lifting was apparently emptying wheelie bins into larger industrial bins. Something which could have been removed from her tasks as there was always at least another 2-4 cleaners in each day.

Correct and I should have said unofficially backing me, I.e. Management are as shocked as myself and some have told me to pursue it. This agency aren't exactly in the good books.

To me that says that you are now acting as a company representative in this and not the aggrieved spouse.

You are in a very precarious position.

Thank you - I have already been informed that as long as I make it clear that I represent my spouse and not my company I am fine and protected from being hounded out of a case.

Fact is if my partner lost her job and that was it I probably would have given stern words at a grievance to the smug little sh... Behind the agency desk who did it and left it at that. It's now more than that because of them.

If she is on Swedish derogation and suspended on medical grounds, i.e. because the risk assessment says the job is too dangerous, then the agency is liable to pay her wages.

Don't quote me on that though. Ring the helpline.

I don't really have any advice but wanted to say I'm sorry for your loss.
  • If you have house insurance then I would suggest looking at that as it often has legal cover
Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked

It is unclear whether the threat of no assignment was actually carried out after the miscarriage or she is still working
