Have I lost?

Hey can anyone help? When I filled out the online claim form I put my current address, as I believed that is what they were asking for. I recieved a letter from my bank (at my current address from their legal team) asking me to send them my account details as they could not find my account, so I did!:rotfl:

I recently received a Notice of Transfer of Proceedings, in which the defendant claims that they have no account holder at the address given on the claim form. My cuurent address is not the address I am registered with for my bank, I did try to change the address several times but they kept messing it up so I gave up, as its my mum's, it wasn't a major problem.

Have I made a fatal mistake. :confused:

    Go into your bank and change the address, Or just fill out the forms again using the address which your account is registered to. Dont give up the banks are playing dirty

    Ok, but is this a valid defence, can they have the case thrown out because the address on the claim form is not the address they have for me? Or is it just their problem????

    I'm no expert but I would have thought it was irrelevant. The unique details are you, your date of birth etc. Lots of people must have moved during the 6 year period.

    The point of the case is related to unlawful charges and whether the address has changed or not, the facts of the case still stand.

    Write them a letter clearly pointing out the address that is correct now with your account details and make sure you send it registered/recorded post. There is no way you can lose the case on the basis of the address.
