Parking Eye Help

Hi,

I am asking for some help, I got a parking ticket from parking eye back in Feb the vehicle is registered to my mum however i am an insured driver. the parking was at burtonwood service station, I didnt notice any signs however that doesnt mean there wasnt any or not visible enough, the car park was almost empty the ticket says i stayed almost 45mins over the 2 free hours. i never knew you had to pay for parking at a motorway service station and I always thought that you should just ignore these tickets that they would just give up, we have now received a 'letter before county court claim' I dont feel i should pay as the car park was nearly empty i wasnt taking space that was needed.

I have seen that i now need to make an appeal, do i just go through the parkingeye contact page on their website?

im really not sure on what i should say in the appeal, any help is really appreciated or do you think i should just pay

    As the car is registered to your mum I'm guessing she is getting the nasty letters about this. She will also be out of time to appeal.

    She should write to Parking Eye naming you as the driver and you can then appeal in your own right.

    Was there a ticket on the windscreen? (Or have PE inferred that there was?)

    If the answer is Yes then the above reply's advice will not work. Otherwise it is the correct course of action.
  • yes she is getting the letters, the court letter was dated last week.

    the ticket only came in the post there wasnt anything on the windscreen.

    What do you mean by "court letter" Have they started proceedings?

    Assuming this isn't at an actual court claim stage, I would get "your Mum" to write to PE giving your name and address as the driver. Say in the letter that this discharges any liability the registered keeper may have under the Protection of Freedoms Act 2012. Any action against the registered keeper will have no foundation and will be vigorously defended, and ensuing costs in defending will be claimed. Right will accordingly be reserved to pursue a claim against Parking Eye for harassment.

    But any appeal or defence based upon
    (a) I didn't know you had to pay at petrol stations
    (b) I didn't read the signs
    (c) The park was almost empty


    will certainly mean you lose.

    You will need to read up on the links given and get some help with any defence you may make should the Nortampton court papers follow.

    Just to clarify - SHE doesn't 'appeal', she writes a letter to formally acknowledge the LBCCC and to effectively 'reset the clock' (don't use those words as it's forum jargon) by naming the driver, name and address. Please refer to the NEWBIES thread section about resetting the clock and the options 'if too late to appeal'.

    Next time, with letters demanding money that look like a scam - please don't assume that advice you knew from Watchdog in 2010, five years ago(!) is still the case. It only needed a Google search to check and you've nearly caused her a court case - the law changed in 2012 and she could have been held 'liable' by the most keen litigator in 'PPC World'. You are lucky she's just in time to name the driver.

    Then you get your own PCN and you can then appeal as per the NEWBIES thread template appeal. You would then win by following our POPLA advice.

    DO NOT PAY. BUT DO NOT IGNORE, SHE MUST NAME THE DRIVER!!

    Yes, but don't become complacent on this. PE are likely to say that as the driver has been named after the 28 day appeal period, it's too late. This is incorrect, but if it arises, you're going to have to deal with it.

    Did you get a free Certificate of Posting from the post office to confirm the 'naming the driver' letter was sent? It's important now that you keep records of dates and letters that are sent.

    If you didn't get the CoP, then send the same letter again, but get a CoP for that.

    And if PE ignore the above letter and issue court papers please DO NOT ignore these, but come back on this thread immediately.
