its been a while since I have posted and im sure alot has changed since I last did this but here goes,
my mother passed away in 2009 so I helped my father with all the paperwork. my father passed away in 2012 and before he passed I managed to reclaim back two mis sold ppi claims for him. he was told that he needed this in order to get the loans that he was after, now that he has passed I had to pay off his mortgage to bank of Ireland, which he had taken out with Bristol and west. my question is can I reclaim the ppi on his behalf as I am legally dealing with his estate and who do I claim with? thankyou all for any help with my problem.

The executor of the estate can make complaints. The reason for complaint obviously cannot include allegations of verbal conversations (i.e. you cannot say he was told to have it). However, it doesn't stop factual complaint reasons.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
thank you for your reply, I have been looking at the paper work and I guess that I claim through bank of Ireland as they took over Bristol and west.0

Most mortgage PPI complaints are rejected even if the holder is still around , your task is therefore made doubly difficult because your father is deceased.0 -
Why, if the Mortgage had PPI, was a claim not made on the insurance for death, this would have possibly repaid the Mortgage.
I don't understand why you had to pay it off?.
Or I have read the post wrong?.0 -
do they mean other PPI and not MPPI?

As Dunstonh has said, it is theoretically possible for the executor of the estate to make a complaint on behalf of the deceased. The obvious problem being that a complaint of Misselling is generally about the advice/information provided to the buyer at the point of sale. As the executor generally was not there it can be hard to construct a credible complaint. The most likely reason is a significant exclusion under the policy which limits the ability to claim significantly.0
