The OP lost the opportunity to not have the emergency services called at the point at which his wife caused the road to be (partially) blocked and contaminated with the fluids from her car. The emergency services have the responsibility to arrange whatever's needed to re-open and decontaminate the road surface ASAP - and they have the legal right to bill whoever's responsible for it. On certain trunk routes, that responsibility (and right) is in the hands of private contractors. You agree to that by using a motor vehicle on the roads.

Yes, there may have already been other fluids on the road - that's a side issue, since the person who spilt them isn't traceable. The person who caused _this_ spill is definitely traceable, since - in the immortal words of Baby Bear - "she's still there!"

So its decided then; the car leaked.

I don't know where you get the idea it didn't from. Put a car - any car - on it's side and leave it there, and it WILL leak. Fuel, engine oil, gear oil, coolant, screenwash, brake fluid. The full complement. NOTHING is designed to be liquid-tight from all angles - all reservoirs have to breath, to allow pressure to release across the full range of operating temperatures and as levels drop.

    From the original post...
My wife was involved in a small car accident, she ... tipped her car onto its side.
    ...
The fire brigade arrived righted the car...

We know that the OP's car was on it's side for a period of time.
We know that all cars leak when on their side for a period of time.
Ergo, it seems to be fairly obvious that the OP's car leaked.

I'm sorry, I didn't get the memo, can you let me know which and when all cars have to leak when they are put on their sides? Cheers.
