Desperate Situation

Hi i will have to keep this brief because i am on a poor mobile phone. I desperatley need to go bankrupt but i cant afford to pay the fees. I am about 43k in debt i am behind on my rent and behind on my council tax. I just found out that i also have a 200 attachment of earnings order on my wages too which has made life very difficult. As you can see by the time of this post i am having servere trouble sleeping and i have a tight chest. I need to get this resolved quickly. Is there anywhere i can get help with the fees? I am runnimg out of options and silly thoughts are going through my mind and i am scared.

    Hi michael 1983l, First step is to make a list of all your creditors, debts and assets. Secondly and most important is contact one of the following debt charities. Please try these they don't charge and are impartial. They will go through all your options with you and if they suggest bankruptcy then come back to this board and we will help you all we can.

    If you're not ‘clicking’ with one of the Debt charities do try another. We advise you to try at least two/three others for your own piece of mind. Your BR could be refused if you have not sought advice.
    Advice on here does not count, this has to be from one of the Debt Charities, an IP, an Accountant or a Solicitor. The Judge just wants to be sure that you can never come back and try and overturn the order on the basis that you were not aware of all the consequences.

    You might want to see if 'Turn 2 Us' can help find you a charity that may be prepared to help with the bankruptcy fee. Here's their website: http://www.turn2us.org.uk

    Your rent and council tax are both priority debts, it would be important to get arrangements in place before further action is taken. We have lots of information about dealing with priority debts which you can find by clicking here.

    Thanks. I been to cab today and spoken to royal british legion as an ex serviceman they have said they can pay the br fee if cab agree bankruptcy is best option. I have spoken to parent of whom i owe lots of money to and they reluctantly agreed a reducedsum which would be covered by my ex wife. The most difficult part for me is out of the way by speaking to my parents. But i am going to call stepchange in the morning because i have to wait at least a week to speak to debt advisor at my local cab and i need the ball rolling as quickly as possible.

    Can anybody explain to me what a bankrutcy restriction order means as it is likely to apply to me. Id look it up myself but i have no access to computer just a rubbish phone sorry.

    I got my fees paid by Royal British Legion. They sent a representative out to my home to talk about circumstances that lead to the BR, that took about 3weeks after CAB contacted them. I then received a cheque made payable to the court about 3/4 weeks after that.

    Just thought I would let you know the timecale for me to be able to book an appointment at court as it took a while, but I was so grateful for getting the fees paid for me.

    Hi - you have had a lot of good advice in the posts above - just stay calm and you will get thought it ok. Most of the posters on this board have been though it and no matter how scary it seems - it is not nearly as scary as NOT going BR and continuing to live with the debt and stress you have now. There are so many reasons people end up going BR from addiction and poor judgement thought to plain bad luck and misfortune - you will find many stories on this board and if you get the chance to look though the old posts - I am sure you will find someone who's story mirrors your own and hopefully see there is life after BR - and for most of us, its a much better life :)

    Hi again Michael

    Everyone who goes bankrupt is subject to certain set restrictions. These include:

    - Being obliged to declare the bankruptcy if seeking to borrow £500 or more;

    - Being barred from holding certain posts e.g. limited company director, and

    - Holding certain public offices, for example as trustee of a charity.

    Bankruptcy restrictions orders (BROs) are a separate matter altogether and will usually only apply in cases where the bankrupt's conduct has been judged reckless or fraudulent. The main effect of a BRO is to extend the duration of the bankruptcy from the usual 12 months to anything up to 15 years in the most extreme cases.

    The "average" person going bankrupt is unlikely to have a BRO imposed if their debts have grown due to factors beyond their control e.g. illness/redundancy/separation etc.

    I hope that helps. Perhaps if you let us know of anything you think is unusual about your particular circumstances, we can offer an opinion on whether a BRO is likely for you.

    Just to clarify what Dennis at NDL was saying. A BRO will extend the restrictions you have during BR for how ever long it has been issued for but you will still be discharged from BR after 12 months.

    As the others have said what makes you think a BRO is likely.

    There was problems with gambling at stages in the past resulting in the debt. However there is a number of mitigating circumstances which led to the gambling.

    Basically I was put on redundancy notice for 9 months at work, I owed a lot of money to my parents at the time and I took loans to try and cover this, but I couldn't get enough.

    The stress of the situation brought out an underlying medical condition, Bi-polar disorder and I started taking medication which really screwed with my head. I gambled at this stage when I was not really of sound mind, with the intention of making up the shortfall for my parents loan but ended up losing a lot of it instead.

    I would be surprised if the OR did not issue a BRO and wouldn't blame them if they did. In which case I will just make it a BRU.
