Help - Supplier has ceased trading, what to do as a creditor?

See FOS sample case 78/03

Perhaps the FOS got it all wrong?
Edit: Not quite the same as I forgot the OP said they bought the items in a high street shop.
So yes, i agree it would be nice for the OP to return and state which High Street Store this was that has ceased trading, but not gone bust.
You see, as there was a store then either the business owned the premises (in which case there are some assets for the OP to go after) or the premises was rented ... but then the landlord would already have started recovery action/winding up against the business, and the OP doesn't suggest that has happened.
Wouldn't surprise me if the OP got the money back, and the OP, the card provider and the business man all are declared to have lived happily ever after... :cool:0 -
I don't see how "cardholder-not-present" can be a reason for refusing chargeback.
"transactions where no goods are provided" seem to be the key words in that case.0 -
Don't worry about it grumbler.
As I say, until the OP comes back and tells us which actual High Street store it was that was allegedly involved here, I don't think it's worth worrying about.
If OP was that interested, I would have thought they would have hung around and/or been back by now to read responses/answer queries arising .0 -
Hi Lokiofnz, is this Jane Jordan Ltd by any chance? We are in the same boat and going down the chargeback route. So far the bank have been fairly positive so would suggest Grumbler to be correct here. Aquamania do you do a credit check on Sainsburys before each weekly shop? Pretty ridiculous comment to make so would suggest getting off your high horse.
good luck with the claim Lokiofnz.0 -

No, I shop at Aldi - it's cheaper :money:
Wherever you shop, I'm sure you take the goods with you rather than just hand over the cash

I'm sure most people would want the goods FIRST, before giving Sainsburys any of their cash, so wouldn't care if they went bust the next day as they got what they paid for.
Now, if you had to pay for them 8 weeks in advance I'd be using a credit card just in case for the S75 protection.0
