Credit Card Purchase Through PayPal

Hello,
My wife purchased some bath panels online in February of this year from an online company who only offered PayPal as a means of payment. After exceeding the delivery date the company advised that delivery would be delayed and several weeks later after making enquiries we were advised delivery would be delayed further. Recently we contacted the company again and have heard nothing so we attempted to request a refund through PayPal. They told us that after 45 days we could not claim a refund. The credit card company advise that because the transaction was via a third party (PayPal) there is nothing they can do either. Does anyone have any advice as to how we can obtain a refund? Many thanks.

an extract I found on which recently.
If you use your credit card to pay for something through PayPal and the funds go direct to the seller, then as long as the company you're buying from has a 'Commercial Entity Agreement' with Paypal you may still be able to claim under Section 75 for any misrepresentation or breach of contract.
PayPal offers its own buyer protection scheme, called PayPal Buyer Protection, so it's worth checking if you'd be covered by that if you have a problem with your purchase.0 -
Small Claims Court - if it's a UK company and if they have some assets to enforce the court decision should they ignore it.0

Who was the seller?
Definitely worth naming and shaming them on here.
Moreover, perhaps someone can help you discover what has happened to them. No point wasting more of your money on collection, if the seller can't pay you back anyway.0 -
The company are called bath panel world. I think they also trade as bath panel store. We subsequently found many posts at the review centre who report similar problems.
We spoke to an agent at the credit card company (Tesco) who wasn't confident we could claim through them, but was sending a form for us to complete. Doesn't sound promising though.
I was under the impression that PayPal is a safe way to make purchases, but if it's after 45 days it seems there is nothing they will do.0 -

Such a shame you didn't check out the details before giving your money to them.
Paypal? That screams of dodgy (unless it's ebay). Only other option is via direct bank transfer. :cool:
