Help with Popla

Hi all

I am at the POPLA stage and before appealing want some advice please...

I appealed to LPS for NTK on the following grounds

- are the damages for trespass, breach of contract or contractual sum
- breakdown of their loss incurred
- sum asked for not being genuine pre-estimate of loss (but this relates to the top two points)
- proof of their status as creditor or of them having contractual authority
- info on the legal land owner

None of these have been referred to in any communications from LPS and in fact the first letter from them after my appeal simply reiterated the charge and the second states my appeal failed on the point of 'parking without a valid pass' (which I never disputed and never actually appealed against and this letter only came about as I reminded them of their obligations to respond to my appeal).

So; now I have the POPLA code finally and I would like advice on the following please

- Do I simply appeal to POPLA on all the above original grounds?
- What impact does POPLA statement on their site have? I cant post links here as a new member :-(
- Any other advice please?

    You can post a broken link by removing the http:// or including spaces.

    Your POPLA appeal is not constrained to the grounds used in your 1st appeal but should include at least the three main winning arguments - Not a GPEOL, no authority/legal standing and non-compliant signage therefore no contract formed with driver.

    Also use the search the forum function for threads by other OP's dealing with the same company/location but check which LPS as there are two LPS parking companies - London Parking Solutions and Local Parking Security - both are normally breach of contract i.e. wording on their NtK and/or signs would say things like "failure to comply/contravening the terms etc etc
